RESOLUTION NUMBER 1448 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 15-86, A REQUEST TO PERMIT A WALK-UP/TAKE-OUT RESTAURANT (981 OCEAN AVENUE) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on September 9, 1986 Jack Haley, 484 Ocean Avenue, Seal Beach, submitted an application for Conditional Use Permit 15-86 to the Department of Development Services, and WHEREAS, the applicant is requesting out/sit-down restaurant on a by the same use~ and to establish a new take- site previously occupied WHEREAS, the subject property contains approximately 5,588 square feet, and is located at the northeast corner of Ocean Avenue and Main Street~ and WHEREAS, the subject property has approximately frontage on Ocean Avenue and 118 feet of Main Street~ and 58 feet of frontage on WHEREAS, the subject property contains a restaurant of 1,821 square feet with three (3) compact parking spaces and seven (7) standard parking spaces provided on site~ and WHEREAS, the surrounding land uses and zoning are as follows: North and West a mixture of offices, commercial retail, commercial services and multifamily residential uses in the C-l (Service Commercial) zone. East - Commercial retail businesses in the C-l (Service Commercial) zone. South - Eisenhower Park, the Municipal Pier, and beach located in the PLU (Public Land Use) zone~ and WHEREAS, Main Street and Ocean Avenue are primary streets developed to their ultimate master planned width of 88 feet~ and WHEREAS, the new restaurant proposed for 981 Ocean Avenue represents no intensification of the prior restaurant use. Hence, no additional parking, beyond participation at current levels in the in-lieu parking program, is required, nor is any further variance application required~ and WHEREAS, the specifics of the restaurant operation are as follows: A. 184 sq. ft. 378 sq. ft. 512 sq. ft. 835 sq. ft. The proposed hours of operation are 6:39 a.m. to 1:39 a.m., Monday through Sunday. The take-out window is expected to be open between 19:99 a.m. and 5:99 p.m., May through September 19. C. The proposed method of alcoholic beverage service is described as: 1. On sale beer and wine. 2. Sit down restaurant with food and alcoholic beverage servers who check all I.D.'s (must be over 21 years) before serving the public. 3. Restaurant will have a 13 foot counter with 7 stools (combination breakfast bar top.); and WHEREAS, on September 19, 1984 the Planning Commission adopted Resolution #1342 approving a walk-up/take-out restaurant at 991 Ocean Avenue. This CUP was approved for Tom and Vicki Winch, and was non-transferable; and WHEREAS, historically, the subject property has been used as a restaurant catering to the beach-going public with take-out facilities; and WHEREAS, Stacy Picascia, Chief of Police, has reviewed existing records and has no reservations about permitting this operation to commence; and WHEREAS, the request is compatible with the surrounding land uses, the community in general, and the General Plan; and WHEREAS, a duly noticed public hearing was held on October 15, 1986. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 15- 86 subject to the following conditions: 1) The applicant shall provide adequate trash facilities as approved by City staff. 2) operation of take-out windows to staff review and possible one year if a sidewalk exists. The location and shall be subject modification after circulation problem 3) Approval shall be subject to all conditions established for Conditional Use Permit 14-86. .~ . , , . .
