RESOLUTION NUMBER 1442
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING CONDITIONAL
USE PERMIT 16-86, A REQUEST TO PERMIT STRUCTURAL
IMPROVEMENTS TO A LEGAL NONCONFORMING RESIDENCE
LOCATED IN DISTRICT III (B-53 Surfside Avenue)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:

WHEREAS, the applicant is requesting to remodel and enlarge the
powder room, dining room and one bedroom of a
nonconforming single family residence in Surfside; and
WHEREAS, the subject property contains approximately 1,350
square feet and is located approximately 410 feet east
of the centerline of Sea Way. (B-53 Surfside Avenue);
and
WHEREAS, the subject property has approximately 25 feet of
frontage on B-Row, Surfside; and
WHEREAS, the subject property contains a single family residence
which is nonconforming due to substandard front and
side yard setbacks, and insufficient parking. The
parking arrangement existing on the site includes a
garage measuring 816" by 161 6", and an uncovered
parking space on leased Southern Pacific right of way;
and
WHEREAS, the surrounding land uses and zoning are:
East, West and South - Single family homes on the A and
B Rows of Surfside Avenue.
North - Southern Pacific right of way leased land; and
WHEREAS, Section 28-2407 of the Municipal Code, adopted as
Zoning Text Amendment 2-84, would permit the proposed
remodel subject to a minor plan review. However, the
zoning regulations specific to Surfside (District III)
require a conditional use permit for structural
alterations to nonconforming buildings; and
WHEREAS,

WHEREAS, the Planning Commission makes the following findings
regarding the proposed remodel:
1. No bedrooms or other living quarters are being
added. The floor plans submitted show the
expansion of an existing bedroom, dining room and
powder room and the addition of a wardrobe in the
new bedroom area. These do not constitute the
addition of living quarters.
2. The only rooms being added are bathrooms, storage
closets, closets or enlargements of existing
rooms. As stated in item one above, the applicant
is requesting the addition of one closet, and the
expansion of three existing rooms.
3. At least one adequate parking space is provided.
The subject property contains one garage parking
space measuring 8'6" by 16'6". These dimensions
are one half foot greater in each direction than
the compact size parking space allowed in
commercial and industrial zones. Therefore, this
garage space is adequate. Moreover, the applicant
shows a second open parking space on leased land
adjacent to the subject property.
4. The conditional use permit requested is compatible
with surrounding uses, the community in general,
and the General Plan. The proposed alterations
will not alter the single family residential
character of the subject property or of the
neighborhood at large. In fact, the expansion of
the existing floor area represents an improvement
to the property, and thus an enhancement to the
community.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Seal Beach does hereby approve Conditional Use Permit
16-86 subject to the following condition:
1. The existing garage shall be maintained for
parking purposes.
2. The open parking space provided on the adjacent
leased land shall be maintained as long as the
lease continues. In the event that such property
is acquired by the applicant, this parking space
shall likewise be maintained.

PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 5th day of
November, 1986 by the following vote:
