RESOLUTION NUMBER 1445 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING APPROVAL OF INTERIM ORDINANCES NO. 1234 AND NO. 1236 TO THE CITY COUNCIL THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, current regulation of the reconstruction of nonconforming buildings partially destroyed is covered by Section 28-2406 of the Municipal Code, which reads as follows: Reconstruction of Nonconforming Building Partially Destroyed. A nonconforming building destroyed to the extent of no more than 50 percent of its value at the time of its destruction by fire, explosion or other casualty or or act of God or the public enemy may be restored and the occupancy or use of such building or part thereof which existed at the time of such partial destruction may be continued subject to all other provisions of this article. The Planning Commission may establish conditions and a time schedule for abatement of any nonconforming building or use~ and WHEREAS, the City Council has requested the preparation of an interim ordinance that would allow the reconstruction of legal nonconforming structures damaged or destroyed by flooding~ and WHEREAS, the City Attorney has prepared Ordinances No. 1234 and 1236, effective from November 10, 1984 to July 1, 1987, which permit such reconstruction~ and WHEREAS, the Council has directed staff to study the City's disaster clause further for possible revision~ and WHEREAS, a duly noticed public hearing was held on December 3, 1986~ and WHEREAS, Ordinances No. 1234 and No. 1236 will not cause any adverse environmental impact as stated in the Initial Study, therefore Negative Declaration 10-86 is recommended in accordance with CEQA guidelines~ and WHEREAS, the City is studying proposals to amend its zoning regulations pertaining to the reconstruction of legal nonconforming buildings destroyed by natural disasters, therefore the interim ordinances provide relief until a final determination can be reached~ and WHEREAS, adoption of the interim ordinance should not be construed as indicating or implying that the City will amend the existing provisions of Section 28-2406 of the Code of the City of Seal Beach, California.
