RESOLUTION NO. 1484 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 13-87, A REQUEST FOR THE GRANTING OF AN ON-SALE BEER AND WINE LICENSE IN CONJUNCTION WITH AN EXISTING RESTAURANT LOCATED AT 12241 SEAL BEACH BOULEVARD THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS; on November 25, 1987, Roy Hall submitted an application for Conditional Use Permit 13-87 to the Department of Development Services; and the applicant is requesting the granting of an on-sale beer and wine in conjunction with an existing restaurant use; and WHEREAS; WHEREAS; the subject of the request is the Parasol Restaurant located at 12241 Seal Beach Boulevard in the Rossmoor Shopping Center; and WHEREAS; the surrounding land uses and zoning are as follows: WHEREAS; North, South and East - A mix of commercial uses in the C-2 (General Commercial) Zone. West - Multi-family residential use in the Residential High Density (RHO) Zone; and on July 21, 1980, Angelo L. Pappas, the previous owner of the Parasol Restaurant, submitted an application for the Conditional Use Permit 12-80, a request for an on-sale beer and wine license at 12241 Seal Beach Boulevard; and on September 3, 1980, the Planning Commission adopted Resolution Number 1217 approving Conditional Use Permit 12-80. Three conditions were attached to CUP 12-80 as follows: WHEREAS; 1. CUP is for on-sale beer and wine at 12241 Seal Beach Boul evard. 2. CUP issued is non-transferrable. WHEREAS; 3. CUP is issued for a period of one year with Commission approval; and in August, 1987, Roy Hall purchased the Parasol Restaurant from Angelo L. Pappas. As conditioned by the P 1 ann in g Co mm is s ion, the bee ran d win e license granted under CUP 12-80 was not transferrable; and WHEREAS; the proposed hours of operation are 6:00 a.m. to 1:00 a.m. daily; and the applicant is proposing to maintain the restaurant as is; and WHEREAS; WHEREAS; Bill Stearns, Chief of Police, has reviewed the existing records and has no reservations about permitting the operation to commence. - ,,- , .. ,~ e -- .. .. pag e 2 of 2 Resolution No. 1484 NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 13- 87 subject to the following conditions: 1. CUP 13-87 is approved for on-sale beer and wine at 12241 Seal Beach Blvd., and is issued to Roy Hall. 2. All alcoholic beverages sold in conjunction with the restaurant operation shall be consumed entirely within the building. 3. No video games or similar amusements shall be permitted on the premises. 4. There shall be no alcoholic beverages advertising in the window area. 5. The applicant shall comply with all restrictions placed on the ABC license by the California Department of Alcoholic Beverage Control. 6. CUP 13-87 is non-transferrable. 7. With the owner's consent, hours of operation will be 6:00 a.m. to 1:00 a.m. daily. 8. CUP 13-87 shall be automatically terminated if the operation is no longer maintained as a "bond fide public eating. place" as defined by the State Department of Alcoholic Beverage Control. 9. All alcoholic beverages sold shall be served by hand within the premises. 10. The term of this permit shall be twelve (12) months, after which time the Planning Commission may extend the permit indefinitely provided that all conditions of approval have been satisfied, and no significant police problems have occurred. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 6th day of January 1988 by the following vote: AYES: NOES: ABSTAIN: ABSENT:
