HomeMy WebLinkAboutPC Res 1485 - 1988-01-20 .. e e RESOLUTION NUMBER 1485 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 15-87, A REQUEST TO CONVERT THREE DWELLING UNITS TO CONDOMINIUMS (222 7~ STREET) THE PLANNING COMMISSION DOES HEREBY RESOLVE: WHEREAS, on December 10, 1987, Wayne and Darlene Shaddox submitted applications for Conditional Use Permit 15-87 and Tentative Parcel Map 87-132 to the Department of Development Services; and WHEREAS, the applicants are requesting to convert three existing apartment units at 222 7th Street to condominium units; and WHEREAS, the subject property is regular in shape and topography, measuring 5875 square feet (50' x 117.51), and; WHEREAS, the subject property is located on the east side of 7th Street, approximately 310 feet south of Electric Avenue; and WHEREAS, the subject property is zoned Residential High Density (RHO); and WHEREAS, the surrounding land uses and zoning are as follows: East, West and South - A mixture of single and multiple family residences within the RHO Zone; and North - A mix of residential uses in the RHO Zone and the Electric Avenue greenbelt in the Public Land Use (PLU) Zone; and WHEREAS, the breakdown of the project is as follows: UNIT A: Floor Area: Parking: Un it Ty pe : UNIT B: Floor Area: Parking: Un it Type: 2,234 square feet Two standard spaces, access from 7th Street Five bedroom, three bath 1,066 square feet Two standard spaces, access from alley. Two bedroom, one bath; and UNIT C: Floor Area: Parking: Un it Type: 1,070 square feet Two standard spaces, access from alley Two bedroom, one bath; and WHEREAS, the subject property meets all of the development standards for condominium conversion in the RHD zone, including height, setbacks, parking and density; and '. e e pag e 2 Resolution 1485 City of Seal Beach WHEREAS, a building inspection has been performed on the subject property, and a list of required corrections prepared; and WHEREAS, pest reports noting the presence of termite infestation on the sub j e c t pro per t y, and r e c 0 mm end i n g mea sur est 0 remedy the problem, have been prepared and submitted to the Department of Development Services; and WHEREAS, the Public Works Department has inspected the subject property and drafted a set of improvements to be performed in conjunction with the proposed condominium conversion; and WHEREAS, the applicants have submitted Covenants, Conditions and Restrictions for review by the City Attorney; and WHEREAS, no additional exterior or interior cosmetic improvements have been proposed; and WHEREAS, on October 20 and 21, 1987, the appl icants notified each tenant of the project of the proposed conversion and relocation benefits available; and WHEREAS, the tenant relocation provisions comply with the requirements of Ordinance 1261 and State law and are hereby approved by the Planning Commission; and WHEREAS, copies of the tenants' receipts of notifications are on file in the Department of Development Services; and WHEREAS, a duly noticed public hearing was held on January 20, 1988; and WHEREAS, the Planning Commission finds that the proposed condominium conversion complies with the standards established by Ordinance Number 1261, adopted by the City Council on December 21, 1987; and WHEREAS, the Planning Commission finds that with corrections and improvements as recommended by the Building and Public Works Departments the project will not pose serious health or safety problems. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 15-87 subject to the following conditions: 1 . Con d i t ion a 1 Use Per m i t 1 5 - 8 7 ish ere by a p pro v ed for the conversion of three existing dwelling units at 222 7th Street to condominium units. 2. Security lighting shall be provided on the subject property as approved by the Department of Development Services. 3. All units shall be provided with smoke detectors as required by the Department of Development Services and the Orange County Fire Department. 4. The return air pipe in the garage ceiling shall be patched as approved by the Department of Development Services. e. . pag e 3 Resolution 1485 City of Seal Beach 5. The appl icants shall allow the inspection of the wall material separating units, and install fire-rated material as required by Ordinance 1261 and the Department of Development Services. 6. The applicants shall perform the primary corrections recommended by the pest reports prepared for the subj ect property by the Western Exterminator Company and dated December 21, 1987. Upon completion of these actions, a Certificate of Correction shall be submitted to the Department of Development Services. 7. The applicants shall remove and reconstruct the parkway bordering the subject property on 7th Street, including curb to grade. The reconstructed parkway shall contain a sidewalk, four and one-half (4 1/2) feet wide, and a three foot width of grass adjacent to the curb. The depressed curb driveway approach shall have a minimum width equal to the width of the garage door opening. 8. The appl icants shall plant trees in the grassy portion of the parkway in accordance with City standards. 9. There shall be separate meters for all utilities with the exception of the water meter. The CC&Rs shall structure payment of the water bills through the Association. 10. Revised Covenants, Conditions and Restrictions shall be submitted with the final parcel map, and shall be subject to review and approval by the City Attorney. 11. All taxes for the fiscal year 1986 - 1987 shall be paid in full, and evidence of payment provided upon submittal of the final parcel map. 12. The property owner andlor developer sha 11 ab ide by the tenant relocation plan approved by the Planning Commission. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 20th day of January 1988 by the following vote: AYES: Commissioners: Sharp, Suggs, Rullo NOES: Comm i s s i oner s: ('\one.
