RESOLUTION NUMBER 1488 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH INDEFINITELY EXTENDING CONDITIONAL USE PERMIT 8-87, AllOWING lIVE ENTERTAINMENT IN CONJUNCTION WITH AN EXISTING RESTAURANT (12309 SEAL BEACH BOULEVARD) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on June 30, 1987, Chai Te Chang submitted an application for Conditional Use Permit 8-87 to the Department of Development Services requesting approval of the addition of live entertainment and dancing to an existing Chinese restaurant, Chang's Gourmet; and WHEREAS, the restaurant is located within the Rossmoor Business Center, a multi-tenant commercial center in the C-2 (General Commercial) zone; and WHEREAS, the surrounding land uses and zoning are as follows: North and South - A mixture of general commercial uses within the Rossmoor Center, and single family' and multiple family homes in Rossmoor, an unincorporated community of Orange County. East - A mixture of open space. in the R-G zone utilized mostly as a golf course retail-commercial uses in the C-2 zone, and residential uses in the City of los Alamitos. West - Multiple family residences in the City of Seal Beach and Rossmoor; and WHEREAS, on August 5, 1987, the Planning Commission of the City of Seal Beach adopted Resolution Number 1466, approving CUP 8-87 subject to nine (9) conditions; and WHEREAS, on January 4, 1988, a letter was sent to Mr. Chang by the Seal Beach Department of Development Services informing him that, as per Condition 8 of Resolution Number 1466, his entertainment license would expire on February 5, 1988 unless it were renewed by the Planning Commission; and WHEREAS, Mr. Chang made the appropriate arrangements by January 15, 1988 with the City to schedule the Pl ann ing Commission review for Wednesday, February 3, 1988; and WHEREAS, a duly noticed Public Hearing was held by the Planning Commission on Wednesday, February 3, 1988; and WHEREAS, the Planning Commission makes the following findings: 1. There have been no complaints regarding the live entertainment at Chang's Gourmet. 2. The applicant has complied substantially with the conditions listed in Resolution Number 1466. 3. Given the above, 1 ive entertainment at Chang's Gourmet has been compatible with the neighborhood and surrounding community. e . pag e 2 Resolution No. 1488 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve Resolution Number 1488, subject to the following conditions: 1. CUP 8-87 is approved for 1 ive entertainment at Chang's Gourmet, 12309 Seal Beach Boulevard, and is issued to Cha i Te Chang. 2. CUP 8-87 is non-transferrable. 3. Entertainment shall be limited to the bar area and the tables immediately adjacent, as outlined on the plans approved by the Planning Commission under Resolution Number 1466. No minors may be permitted in this area unless accompanied by a parent or guardian. 4. Dancing and dance bands or disc jockeys shall be 1 imited to Wednesday through Saturday nights, between the hours of 6:00 p.m. and 1 :00 a.m. 5. Solo musicians shall be permitted Sundays through Saturdays, between the hours of 6:00 p.m. and 1:00 p.m. 6. A copy of the business regulations for entertainment cafes shall be posted on the premises in a conspicuous location. 7. All on-site, outdoor signage associated with the live entertainment shall be approved in advanced by the Department of Development Services. 8. During the time that live entertainment is taking place, the rear service door on the northern side of the building shall remain closed to prevent noise transmission.
