RESOLUTION NUMBER 1496 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING VARIANCE 1-88, A REQUEST TO PERMIT AFTER-THE-FACT A KITCHEN EXPANSION INTO THE REQUIRED GARAGE AREA AT 420 MARBLE COVE, SEAL BEACH ". WHEREAS, on January 8, 1988, Estelle Summerville submitted an application for Variance 1-88 to the Department of Development Services; and WHEREAS, the applicant is requesting approval of an after- the-fact kitchen expansion into the required garage area; and WHEREAS, the request for a variance is an effort on the part of the applicant to bring her after-the-fact kitchen expansion into conformity with the Code of the City of Seal Beach; and WHEREAS, a violation exists due to the unpermitted conversion of approximately 170 square feet of the 400 square foot, two car garage into an expansion of the existing kitchen without the proper permits; and WHEREAS, Ms. Summerville was first notified of her property's violation of the City Code by the Department of Development Services on November 19, 1984; and WHEREAS, on December 2, 1987, in a meeting with representatives of the City of Seal Beach Prosecutor's Office and Department of Development Services, Ms. Summerville agreed to apply for a variance by January 11, 1988 for improvements to her property; and WHEREAS, the subject property is a rectangular lot measuring 511 x 100' or 5,100 square feet; and WHEREAS, according to Section 28-402(2}(a) of the Code of the City of Seal Beach, the property at 420 Marble Cove may have up to 45% lot coverage. The lot coverage of the property currently is approximately 32%. Therefore, the addition of floor space to the dwelling is possible without having to encroach into the required garage area; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on February 17, 1988; and WHEREAS, the Planning Commission makes the following findings: 1. The request to allow an after-the-fact conversion of one of two required covered parking spaces into an e x pan s ion 0 f the kit c hen wo u 1 d not a f f e c t the low density character of the property, and hence would not adversely affect the general plan. 2. The subject property is a standard rectangular lot 511 x 100' and does not exhibit any special circumstances nor impose any undue hardship on the owner distinct from other such lots in the vicinity and zone. Likewise, existing lot coverage, which is approximately 32% (45% is the maximum allowable), does not impose any undue hardship or create any special circumstances. . . " Resolution No. 1496 Page 2 of 2 3. Because there are no unusual circumstances to justify the approval of Variance 1-88, the granting of the variance would constitute a grant of special privilege. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby deny Variance 1-88. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 2nd day of March, 1988, by the following vote: AYES: NOES: ABSENT: ABSTAIN: Chairman Covington, Commissioners Jessner, Sharp, Suggs.
