HomeMy WebLinkAboutPC Res 1498 - 1988-03-16 j e e RESOLUTION NUMBER 1498 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING VARIANCE 2-88, A REQUEST TO PERMIT A ROOM ADDITION THAT EXCEEDS THE MAXIMUM LOT COVERAGE FOR THE LOW DENSITY RESIDENTIAL DISTRICT (4e5 OPAL COVE) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on February 21, 1988, Robert application for Variance 2-88 Development Services; and , Raices submitted an to the Department of WHEREAS, the applicant is requesting permission, after the fact, to permit a room addition of 432 square feet, resulting in a lot coverage of 47.9 square feet; and WHEREAS, the subject property is a rectangular parcel measuring approximately 51 feet by lee feet; and WHEREAS, the surrounding land uses and zoning are as follows: North, East, West - Single family residences in the RLD Zone; South - A mixture of single family residences in the RLD Zone and commercial uses in the C-2 (General Commercial) Zone; and WHEREAS, according to the plans submitted by the applicant, the subject property contains a single family residence covering approximately 2e12 square feet and a partially completed addition of 432 square feet; and WHEREAS, on November 19, 1986, the Planning Commission denied Variance 15-86, a request identical to the present variance application, by adopting Resolution Number 1443; and WHEREAS, since the Commission's action on Variance 15-86 became effective, staff has been pursuing a code enforcement case against the subject property; and WHEREAS, the present variance request is in response to directions by the City Attorney to either remove the illegal room addition or seek after-the-fact approval through the variance process; and WHEREAS, Variance 2-88 is required to permit the proposed room addition because the resulting lot coverage shown by the applicant, 47.9 percent, exceeds the maximum of 45 percent allowed by code; and WHEREAS, the Planning Commission hearing on Wednesday, Variance 2-88; and held March a duly noticed public 2, 1988 to consider WHEREAS, the Planning Commission makes the following findings: 1. The granting affect the residential surroundings of Variance 2-88 would not adversely General Plan. The low density character of the property and its would not be changed by the addition. 2. There are no special circumstances applicable to the subject property including size, shape, topography, location or surroundings, such that the strict application of the zoning ordinance deprives the property of privileges enjoyed by other property in the same vicinity and zone. The ~ e e Resolution Number 1498 Page Two subject property is a rectangular lot, mea~uring approximately 51 feet by 1BB feet. Neither the shape of the property nor its size deviate from the standard lot configurations for the tract and the RLD Zone in general. Consequently, the application of the 45 percent lot coverage does not impose any property-related hardship on the applicant distinct from any other property in the vicinity and zone. 3. The granting of Variance 2-88 would constitute a grant of special privilege inconsistent with other limitations upon other properties in the same vicinity and zone because there are no unusual property-related circumstances to support a variance. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby deny Variance 2-88. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 16th day of March, 1988 by the following vote: AYES Commissioner(s} NOES Commissioner(s} ABSTAIN Commissioner(s} ABSENT Commissioner(s} Commission
