A RESOLUTION OF
THE CITY OF SEAL
USE PERMIT 1-88,
OF BEER, WINE
CONJUNCTION WITH
RANCH PARKWAY)
THE PLANNING COMMISSION OF
BEACH APPROVING CONDITIONAL
A REQUEST TO PERMIT THE SALE
AND DISTILLED SPIRITS IN
A NEW RESTAURANT (3005 OLD
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on January 28, 1988, Laurie B. Neuse filed an
application for Conditional Use Permit 1-88 on behalf
of Spaghettini, a California Limited Partnership, with
the Department of Development Services; and
WHEREAS the applicant is requesting approval for the sale of
beer, wine and distilled spirits in conjunction with a
new restaurant located at 3005 Old Ranch Parkway; and
WHEREAS, the subject property is located within the Bixby Office
Park, a multiple-tenant, mixed use project located at
Seal Beach Boulevard and the 1-405 freeway; and
WHEREAS, the surrounding land uses and zoning are as follows:
North - A flood control channel and single family homes
located in Rossmoor, an unincorporated community in the
County of Orange;
South - The Beverly

WHEREAS, the restaurant for which CUP 1-88 is requested is
Spaghettini, an Italian dinner house incorporating a
lounge and dining room in 8,474 square feet of gross
floor area. Spaghettini is currently under
construction; and
WHEREAS, on September 8, 1987, the City Council approved the
precise plans for Spaghettini, including floor plans,
parking, architecture and restaurant concept; and
WHEREAS, the proposed hours of operation are as follow:
Lunch:
Monday through Saturday, 11:00 a.m. to 3:00
p.m.;
Dinner:
Monday through Thursday, 4:00 p.m. to 10:00
p.m.; Friday and Saturday, 4:00 p.m. to 11:00
p.m.; and Sunday, 3:00 p.m. to 9:00 p.m.; and
WHEREAS, Chief of Police William Stearns has reviewed the
existing records and has no reservations about
permitting this operation to commence; and
WHEREAS,
the Planning Commission held a
hearing on Wednesday, March 16,
Conditional Use Permit 1-88; and

WHEREAS, the Planning Commission makes the following findings:

1. The service of beer, wine and distilled spirits in
conjunction with the new restaurant at 3005 Old
Ranch Parkway will not impact the surrounding
neighborhood. The subject property is adjacent to
both Seal Beach Boulevard and the 1-405 freeway.
Moreover, the property is surrounded on three
sides by commercial and public uses. The
residential community of Rossmoor abuts the Bixby
Offi~e Park, but is separated by a masonry wall,
heavy landscaping and a flood control channel.
2. The service of beer, wine and distilled spirits is
appropriate for the dinner house atmosphere
proposed for Spaghettini.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Seal Beach does hereby approve Conditional Use Permit
1-88 subject to the following conditions:
1. Conditional Use Permit 1-88 is approved for the sale of
beer, wine and distilled spirits in conjunction with the
restaurant at 3005 Old Ranch Parkway.
2. Conditional Use Permit 1-88 is issued to Spaghettini, a
California Limited Partnership, and is nontransferable.
3. No video games or similar amusements shall be permitted on
the premises.
4. There shall be no alcoholic beverage advertising in the
window areas.
5.
CUP 1-88 shall be automatically terminated if
is no longer maintained as a "bona fide public
as defined by the California Department

7. With the applicant's consent, the hours of operation shall
be as follow:
Monday through Thursday, 11:00 a.m. to 10:00 p.m.
Friday and Saturday, 11:00 a.m. to 11:00 p.m.
Sunday, 3:00 p.m. to 9:00 p.m.
8. The term of this permit shall be for twelve (12) months,
after which time the Planning Commission may extend the
permit indefinitely provided that all conditions of approval
have been satisfied, and no significant police problems have
occurred.

PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 16th day of
March, 1988 by the following vote:
