RESOLUTION NUMBER 1500
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SEAL BEACH APPROVING
CONDITIONAL USE PERMIT 2-88, A REQUEST
TO PERMIT THE SALE OF BEER AND WINE
IN CONJUNCTION WITH A NEW RESTAURANT
(3001 OLD RANCH PARKWAY)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on February 8, 1988, Laurence R. Cooper filed an
application for Conditional Use Permit 2-88 on behalf
of the Souper Corporation, with the Department of
Development Services; and
WHEREAS, the applicant is requesting approval for the sale of
beer and wine in conjunction with a new restaurant
located at 3001 Old Ranch Parkway; and
WHEREAS, the subject property is located within the Bixby Office
Park, a multiple-tenant, mixed use project located at
Seal Beach Boulevard and the 1-405 freeway; and
WHEREAS, the surrounding land uses ande zoning are as follow:
North - A flood control channel and single family homes
located in Rossmoor, an unincorporated community in the
County of Orange;
South - The Beverly Manor reservoir and fire station,
separated from the subject property by the 1-405
freeway;
West - Office buildings within the Bixby Office Park;
East - A service station in the C-2 (General
Commercial) zone, separated from the subject property
by Seal Beach Boul evard; and
WHEREAS, on September 8, 1987, the City Council approved the
precise plans for The Soup Exchange, including floor
plans, parking, architecture and restaurant concept;
and
WHEREAS, the proposed hours of operation are as follows:
Daily 11:00 a.m. to 9:30 p.m.; and
WHEREAS, Chief of Police William Stearns has reviewed the
existing records and has no reservations about
permitting this operation to commence; and
WHEREAS, the Planning Commission held a duly noticed public
hearing on Wednesday, March 16, 1988 to consider
Conditional Use Permit 2-88; and
WHEREAS, the Planning Commission makes the following findings:
1. The service of beer, wine and distilled spirits
in conjunction with the new restaurant at 3001 Old
Ranch Parkway will not impact the surrounding
neighborhood. The subject property is adjacent to
both Seal Beach Boulevard and the 1-405 freeway.
Moreover, the property is surrounded on three
sides by commercial and public uses. The residential
community of Rossmoor abuts the Bixby Office Park, but
is separated by a masonry wall, heavy landscaping and a

2. The service of beer and wine is appropriate for
the type of restaurant proposed in The Soup Excha.nge.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Seal Beach does hereby approve Conditional Use Permit
2-88 subject to the following conditions:
1. Conditional Use Permit 2-88 is approved for the sale of beer
and wine in conjunction with the restaurant at 3001 Old
Ranch Parkway.
2. Conditional Use Permit 2-88 is issued to The Soup Exchange,
and is non-transferrable.
3. No video games or similar amusements shall be permitted on
the premises.
4. There will be no alcohol ic beverage adve~tising in the
window areas.
5. CUP 2-88 will be automatically terminated if the operation
is no longer maintained as a "bona fide public eating place"
as defined by the Ca1 ifornia Department of Alcohol ic
Beverage Control.
6. The applicant shall comply with all restrictions placed on
the ABC license by the California Department of Alcoholic
Beverage Control.
7. The term of this permit shall be for twelve (12) months,
after which time the Planning Commission may extend the
permit indefinitely provided that all conditions of approval
have been satisfied, and no significant police problems have
occurred.
8. With the app1 icant' s consent, the hours of operation shall
be from 11:00 a.m. to 9:30 p.m. daily.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 16th day of
March, 1988 by the following vote:
