RESOLUTION NUMBER l5Bl A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 3-88, A REQUEST TO TRANSFER AN ON- SALE GENERAL LIQUOR LICENSE IN CONJUNCTION WITH THE SALE OF AN EXISTING RESTAURANT (62B PACIFIC COAST HIGHWAY) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on February 24, 1_98 e., G~n~ral Mi ll.JL~estaurants, ~nc.,. dba Red Lobster, filed an application for Conditional Use Permit 3-88 with the Department of Development Services; and WHEREAS, the applicant is of an on-sale with the sale of Highway; and requesting app"roval for the transfer general liquor license in conjunction Seafood Broiler at 62B Pacific Coast WHEREAS, the subject property is located within the Bay City Center, a multiple-tenant commercial center located on Pacific Coast Highway between 5th Street and Marina Drive; and WHEREAS, the land uses and zoning surrounding the Bay City Center are as follows: North and West - A mix of commercial and single family residential uses i~ the C-2 (General Commercial) and RLD (Low Density Residential) Zones; -Seu-th- ---A -mix of commercial and residential uses in the- C-2 and RHD (High Density Residential) Zones; East - Single family residential uses in the RLD Zone; and WHEREAS, on August 6, 198B, the Planning Commission approved Resolution Number 1216 approving on-sale beer and wine for Seafood Broiler subject to three conditions: A. CUP for on-sale beer and wine at 62B Pacific Coast Highway; B. CUP issued is non-transferrable; C. CUP is issued for a period of one year; renewal at the end of one year with Commission approval; and WHEREAS, no documentation exists in the Department of Development Services files relating to the upgrade of the beer and wine license to a general liquor license; and WHEREAS, the applicant is proposing a minor remodel to the restaurant to change the kitchen equipment and to change the fish market into additional waiting area. Otherwise, the restaurant will be maintained as is; and WHEREAS, the proposed hours off operation are Sunday through Thursday, 11:3B a.m. to lB:BB p.m., and Friday and Saturday, 11:3B a.m. to 11:BB p.m.; and WHEREAS, Chief of Police William Stearns has reviewed the existing records and has no reservations about permitting this operation to commence; and . /It '. e . Resolution Number l5~1 Page Two WHEREAS, the Planning Commission held a hearing on Wednesday, March 16, Conditional Use Permit 3-88; and duly noticed public 1988 to consider WHEREAS, the Planning Commission finds, based on the history of full-liquor service on the subject property and the applicant's proposal to maintain the restaurant as is, that Conditional Use Permit 3-88 is compatible with the surrounding nei~hborhoo~. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 3-88 subject to the following conditions: 1. Conditional Use Permit 3-88 is approved for the sale of beer, wine and distilled spirits in conjunction with the restaurant at 62~ Pacific Coast Highway. 2. Conditional Use Permit 3-88 is issued to General Mills Restaurants, Inc., dba Red LObster, and is nontransferable. 3. No video games or similar amusements shall be permitted on the premises. 4. There shall be no alcoholic bever~ge advertising in the window areas. 5. CUP 3-88 shall be automatically terminated if is no longer maintained as a "bona fide public as defined by the California Department -Bev-e-J:.a-g-e-ee-l'1-t E 01 . - the operation eating place" of Alcoholic 6. The applicant shall comply with all restrictions placed on the ABC license by the California Department of Alcoholic Beverage Control. 7. The term of this permit shall be for twelve (12) months, after which time the Planning Commission may extend the permit indefinitely provided that all conditions of approval have been satisfied, and no significant police problems have occurred. 8. With the applicant's consent, hours of operation shall be Sunday through Thursday, 11:30 a.m. to l~:~~ p.m., and Friday and Saturday, 11:3~ a.m. to ll:~~ p.m. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 16th day of March, 1988 by the following vote: AYES NOES ABSTAIN ABSENT ssion
