RESOLUTION NUMBER 1505 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 4-88, A REQUEST TO PERMIT THE ADDITION OF MASSAGE THERAPY FOR WOMEN TO AN EXISTING BODY AND SKIN CARE BUSINESS (322 MAIN STREET) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on March 30 1988, Jerri L. Cocks application for Conditional Use Permit Department of Development Services; and submitted an 4-88 to the WHEREAS, the applicant is requesting permission to add massage therapy to an existing body and skin care business at 322 Main Street, #4; and WHEREAS, the subject property is a rectangular parcel measuring 75 feet by 117.5 feet, or approximately 8,812 square feet; and WHEREAS, the subject property contains a multiple tenant commercial building containing five suites: Suite #4, which the applicant proposes to occupy, presently holds a beauty salon which specializes in skin and body care and the remaining suites contain a liquor store, a stationery store, a law office and another beauty salon; and WHEREAS, the surrounding land uses and zoning are as follow: North, South and West: A mixture of conforming and nonconforming retail and service commercial uses in the C-l Zone; East: A mixture of conforming and nonconforming single and multiple family residential uses in the RHO (High Density Residential) Zone; and WHEREAS, Conditional Use Permit 4-88 is required to permit the proposed massage therapy business because the use is not specifically authorized under the C-l Zone. Section 28-1300 of the zoning ordinance does permit retail or service establishments not listed in the ordinance which cater directly to consumers when the Planning Commission determines that such uses meet the intent of service commercial uses and the general plan; and WHEREAS, the applicant initially is proposing to offer massage services on Fridays only, from 11:00 a.m. to 6:00 p.m. As the business becomes established, the applicant is planning to operate during daylight hours only, no longer than from 10:00 a.m. to 8:00 p.m.; and WHEREAS, the Orange County Health Care Agency has issued a report stating that the proposed massage business is in compliance with the Health Agency requirements, and is approved to operate in conjunction with the existing facial and body care business; and WHEREAS, as required by Section 12-7 of the Code of the City of Seal Beach, the Chief of Police will investigate the background of the applicant following the Planning \ " . RESOLUTION #1505 Page Two Commission's determination on the appropriateness of this use; and WHEREAS, the Planning Commission held a duly noticed public hearing on Wednesday, May 4, 1988; and WHEREAS, the Planning Commission makes the following findings: 1. The proposed massage service for women is compatible with the C-l (Service Commercial) Zone and consistent with the General Plan. The land use element summary describes service commercial land uses as "commercial establishments selling a broad range of convenience and consumer goods or providing a variety of personal services." The proposed massage therapy business falls within the latter category. In addition, beauty parlors are permitted inn both the c-o and C-I Zones. The proposed massage business would be established in conjunction with an existing skin and body care business, services which are typically offered in beauty parlors. 2. The proposed business is compatible with surrounding land uses and the community in general. The predominant land use around the subject property is commercial, and commercial uses are permitted by right on the site. Since the massage business is consistent with the service commercial land use category, the issuance of this Conditional Use Permit will not have any greater impact on the surrounding area than would any other use permitted in the C-l Zone. Further, the Health Department has reviewed this application, and has no reservations about the business at this time. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 4-88 subject to the following conditions: 1. Conditional Use Permit 4-88 is hereby approved for the establishment of a massage therapy business for women only in conjunction with an existing skin and body care business at 322 Main Street, #4. 2. Conditional Use Permit 4-88 is issued to Jerri L. Cocks and is nontransferable. 3. All massage provided by provided on site at 322 areas specified in the Commission. the proposed business shall be Main Street, #4, and within the plans approved by the Planning 4. With the applicant's consent, hours of operation shall not extend beyond 10:00 a.m. and 8:00 p.m. 5. The term of this Conditional Use Permit shall be for one (1) year, after which time the Planning Commission shall review the CUP and may extend it indefinitely. . . .. .' . . . .'
