RESOLUTION NUMBER l5S6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL ADOPTION OF ZONING TEXT AMENDMENT 7-87, A REQUEST TO AMEND THE ZONING REGULATIONS GOVERNING STRUCTURAL ALTERATIONS TO NONCONFORMING RESIDENTIAL USES AND TO ESTABLISH REGULATIONS PROHIBITING PARKING IN FRONT YARDS THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, in September 1987, the City Council initiated a portion of Zoning Text Amendment 7-87 in response to concerns about a provision of the Code of the City of Seal Beach which requires one parking space per unit for minor additions to nonconforming residential properties above a density threshold of 3S units per acre; and WHEREAS, the Planning Commission initiated another portion of ZTA 7-87 on February 17, 1988 after staff presented a report to the Commission noting some inequities in the zoning ordinance relating to structural modifications to nonconforming residential uses; and WHEREAS, in response to a number of complaints from citizens, the City Council initiated an amendment addressing the parking of motor vehicles in the unpaved portion of the front setback; and WHEREAS, a draft ordinance has been prepared which amends Chapter 28 of the Code of the City of Seal Beach to remove the density threshold from the parking requirements for additions to nonconforming residential uses, allow some administrative approval of additions to residential uses which are nonconforming only due to setbacks, extend the administrative approval element to Surfside and prevent parking motor vehicles in front yards; and WHEREAS, Zoning Text Amendment 7-87 will not adversely affect the General Plan as it will not alter land uses. Rather ZTA 7-87 will encourage property owners to maintain attractive residential areas, and facilitate the maintenance and improvement of nonconforming residential properties; and WHEREAS, Zoning Text Amendment 7-87 will not cause any adverse environmental impact as stated in Negative Declaration lS-87, and therefore the Planning Commission recommends this Negative Declaration to the City Council; and WHEREAS, Zoning Text Amendment 7-87 will promote the health and welfare of the community. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby recommend to the City council Zoning Text Amendment 7-87. .. . .
