Resolution No. 1510 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH, APPROVING CONDITIONAL USE PERMIT 7-88, A REQUEST TO TRANSFER AN OFF-SALE GENERAL LIQUOR LICENSE TO THE NEW OWNER AT 1780 PACIFIC COAST HIGHWAY THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on July 6, 1988, Julius Dibsy submitted an application for Conditional Use Permit 7-88 to the Seal Beach Department of Development Services; and WHEREAS, the applicant is requesting approval of the transfer of an off-site general liquor license in conjunction with an existing convenience store located at 1780 Pacific Coast Highway, Seal Beach, CA; and WHEREAS, the surrounding land uses and zoning are as follows: ;: " North - across Pacific Coast Highway are single family homes zoned Residential Low Density. South - is the Shore Shop commercial center, zoned C-2, and residential units zoned Residential Medium Density. West - is a combination of commercially zoned property and Residential Medium Density zoned properties; and WHEREAS, the applicants are proposing to maintain the convenience store as iS7 and WHEREAS, no previous Conditional Use Permit for an off-sale liquor license exists for this subject property; and WHEREAS, the proposed hours of operation are 6:00 A.M. to 2:00 A.M. daily. WHEREAS, william Stearns, Chief of police, has reviewed the existing records and has no reservations about permitting the operation to commence; and WHEREAS, the proposed use is categorically exempt from the requirements of the California Environmental Quality Act (Code section 15301); and WHEREAS, the Planning Commission held a duly noticed public hearing on this matter on August 3, 1988, in the City Council Chambers; and WHEREAS, the Planning commission makes the following findings: 1. Granting the transfer will not create a significant impact to the surrounding area, since the busines~ has existed for several years, and the transfer will not increase or intensity the existing use. .. e . . ., . . Page 2 Resolution No. 1510 2. The current use has not posed any problems to the surrounding area. 3. The Chief of police has no reservations regarding the transfer to the new owners. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 7-88, subject to the following conditions: 1. CUP 7-88 is approved for off-sale general liquor license at 1780 Pacific Coast Highway, and is issued to Julius Dibsy. 2. CUP 7-88 is non-transferrable. 3. No alcoholic beverage advertising or display devices shall be located in the window areas or outside the store. 4. No license shall be issued until all illegal alcoholic beverage advertising is removed from the window areas and outside of the store. 5. with the applicant's consent, hours of operation shall be daily 6:00 A.M. to 2:00 A.M. 6. The applicant shall comply with all restrictions placed on this license by the State Department of Alcoholic Beverage Control. 7. The term of this permit shall be twelve (12) months, after which time the Planning Commission will review and may extend the permit indefinitely provided that all conditions of approval have been satisfied and no significant police problems have occurred. 8. No video games shall be allowed in the store.
