RESOLUTION NUMBER 1511 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING AN INDEFINITE EXTENSION FOR CONDITIONAL USE PERMIT 9-87, AN ON-SALE FULL LIQUOR LICENSE IN CONJUNCTION WITH AN EXISTING RESTAURANT LOCATED AT 941 PACIFIC COAST HIGHWAY THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on July 29, 1987, a representative of Denny's Inc., submitted an application for Conditional Use Permit 9-87 to the Seal Beach Department of Development Services; and WHEREAS, the applicant requested approval of the transfer of an on-sale full liquor license in conjunction with an existing restaurant located at 941 Pacific Coast Highway, Seal Beach, CA; and WHEREAS, the subject property is in the Seal Beach Center, a multiple-tenant center located between Bolsa Avenue and Balboa Drive on Pacific Coast Highway; and WHEREAS, the surrounding land uses and zoning are as follows: North - single family homes located in the RLD (Residential Low Density) zone. South - A mix of commercial and residential uses and a church in the C-2 (General commercial) and RLD zones. East - single family homes in the RLD zone. West - A mix of commercial and residential uses in the C-2 and RLD zones; and WHEREAS, proposed hours of operation are 24-hours a day, seven days a week; and WHEREAS, the restaurant in question is currently serving alcoholic beverages due to an oversi te by the State Department of Alcoholic Beverage Control transferred the liquor license from the previous tenant without contact the city; and WHEREAS, on February 6, 1985, the Planning Commission adopted Resolution Number 1358 approving Conditional Use Permit 21-84, a request for approval of a permit for on-sale beer, wine and distilled spirits in conjunction with the proposed expansion to an existing restaurant located at 941 Pacific Coast Highway; and WHEREAS, william Stearns, Chief of police, has reviewed the existing records and has no reservations about permitting the operation to commence; and WHEREAS, the request is compatible with the surrounding land uses, the community in general, and the General Plan; and WHEREAS, at its regular meeting of september 2, 1987, the Planning Commission of the City of Seal Beach approved Conditional Use Permit 9-87 subject to the conditions set forth in Resolution Number 1472. WHEREAS, a duly noticed public hearing was held on August 17, 1988. .. .... . . Page 2 - Resolution No. 1511 - City of Seal Beach NOW, THEREFORE BE IT RESOLVED that the Planning Commission of th~ City of Seal Beach does hereby approve Conditional Use Permit 9-87 subject to the following conditions: 1. CUP 9-87 was approved on september 2, 1987, for on-sale beer, wine and distilled spirits at 941 Pacific Coast Highway, issued to Denny's Restaurant, Inc. and is now before the Planning Commission for consideration of an indefinite extension. 2. All alcoholic beverages sold in conjunction with the restaurant operation shall be consumed entirely within the restaurant portion of the building. 3. No video games or similar amusements shall be permitted on the premises. 4. There shall be no alcoholic beverage advertising in the window areas. 5. The applicant shall comply with all restrictions placed on the ABC license by the California Department of Alcoholic Beverage Control. 6. CUP 9-87 is non-transferrable. 7. There shall be no sale of alcoholic beverages after 1:30 a.m., and all alcoholic beverages shall be consumed by 2:00 a.m. 8. CUP 9-87 shall be automatically terminated if the operation is no longer maintained as a "bona fide public eating place" as defined by the State Department of Alcoholic Beverage Control. 9. All alcoholic beverages sold shall be served by hand within the premises. 10. The full menu shall be served at every seat within the premises. 11. Conditional Use Permit 9-87 shall be granted indefinitely, provided that all applicable conditions of approval continue to be satisfied. Determination of non-compliance with any of the above-listed conditions will result in immediate revocation of the CUP.
