RESOLUTION NUMBER 1512
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SEAL BEACH APPROVING .
AN INDEFINITE EXTENSION FOR CONDITIONAL
USE PERMIT 7-87, AN ON-SALE BEER AND
WINE LICENSE IN CONJUNCTION WITH A
RESTAURANT (900 OCEAN AVENUE).
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on May 27, 1987, a representative of Ruby's Diner, Inc.
submitted an application for Conditional Use Permit
7-87 to the Seal Beach Department of Development
Services; and
WHEREAS, the applicant requested approval of an on-sale beer
a~d wine license used in conjunction with Ruby's
Diner, a restaurant located at 900 Ocean Avenue,
Seal Beach, California; and
WHEREAS, the restaurant is located at the end of the rebuilt
Seal Beach municipal pier; and
WHEREAS, the' surrounding land uses and zoning are as follow:
North - mix of commercial and residential uses in
the C-l (Service Commercial) and RHD (Residential
High Density) zones.
South - the beach located in the PLU (Public Land
Use) zone.
East - a mixture of multi-family and single family
uses in the RHD zone.
West - municipal beach and pier parking area and
parking area in the PLU zone; and
WHEREAS, Ruby's Diner currently occupies the newly completed,
City-owned 2,679 square foot restaurant at the end of
the Seal Beach pier; and
WHEREAS, the Seal Beach pier was severely damaged by storms in
January 1983, and reopened after reconstruction in
January 1985; and
WHEREAS, with the applicant's consent, the restaurant's hours of
operation will be 7:00 a.m. to 10:00 p.m., Monday
through Sunday; and
WHEREAS, william Stearns, Chief of police, has reviewed the
existing records and has no reservations about
permitting the operation to commence; and
WHEREAS, the request is compatible with the surrounding land
uses, the community in general, and the General Plan;
and
WHEREAS, a duly noticed Public Hearing was held on
August 17, 1988.

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Seal Beach does hereby approve Conditional Use Permit
7-87 subject to the following conditions:
1. CUP 7-87 was approved on August 19, 1987, for.
on-sale beer and wine at 900 Ocean Avenue, and
issued to Ruby's Diner, Inc.
2. All alcoholic beverages sold in conjuncti~ wi~b--the
restaurant operation shall be consumed entirely on the
premises.
3. There shall be no alcoholic beverages advertisinq
in the window area.
4. The applicant shall comply with all restrictions
placed on the ABC license by the California
Department of Beverage Control.
5. CUP 7-87 is non-transferrable.
6. CUP 7-87 shall be granted indefinitely provided
that all applicable conditions of approval continue
to be satisfied. Determination of non-compliance
with any of the above-listed conditions of approval
will result in immediate revocation of this CUP.
7. Hours of operation shall be from 7:00 a.m. to
10:00 p.m., Monday through Sunday.
8. No video games or similar amusements shall be
permitted on the premises.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 17th day
of August, 1988, by the following vote:
