HomeMy WebLinkAboutPC Res 1520 - 1988-10-05 \- . e -1 RESOLUTION NUMBER 1520 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 10-88, A REQUEST TO TRANSFER AN OFF-SALE LIQUOR LICENSE IN CONJUNCTION WITH AN EXISTING GROCERY STORE AT 1101 PACIFIC COAST HIGHWAY. WHEREAS, on August 24, 1988, a representative of Vons Companies, Inc. submitted an application for Conditional Use Permit 10-88 to the Seal Beach Department of Development Services. WHEREAS, the applicant is requesting approval of the transfer of an off-sale full liquor license in conjunction with an existing grocery store located at 1101 Pacific Coast Highway, Seal Beach, CA. WHEREAS, the subject property is located in the Seal Beach Center, a multiple-tenant center located between Bolsa Avenue and Balboa Drive off Pacific Coast Highway. WHEREAS, the surrounding land uses and zoning are as follows: North - Single family homes located in the RLD (Residential Low Density) zone. South - A mix of commercial and residential uses in the C-2 (General Commercial) and RHD (Residential High Density) zones. East - Single family homes in the RLD zone. West - A mix of commercial and residential uses in the C-2 and RLD zones. WHEREAS, the subject property is formerly the site of Safeway, which acquired a liquor license from the Department of Alcoholic Beverage Control in 1966. WHEREAS, the applicant, Vons companies, Inc., has acquired all Southern California Safeway stores as of August 27, 1988. WHEREAS, Vons is proposing to maintain the store as is, with the exception of a change in signage, for which the appropriate building permits have been obtained. WHEREAS, the hours of operation are 24 hours a day, seven days per week. WHEREAS, william Stearns, Chief of Police, has reviewed the existing records and has no reservations about permitting this operation to continue. WHEREAS, a duly noticed public hearing was held on October 5, 1988. NOW, THEREFORE, BE IT RESOLVED that the Planning commission of the City of Seal Beach does hereby approve Conditional Use Permit iO-88 subject to the following conditions: 1. CUP 10-88 is approved for an off-sale general liquor license at 1101 Pacific Coast Highway, and is issued to Vons companies, Inc. ',. . e .' ; page 2 of 2 - Resolution 1520. 2. All alcoholic beverages sold in conjunction with the store shall be for off-site consumption only. 3. No video games or similar amusements shall be permitted on the premises. 4. There shall be no advertisement of alcoholic beverages in the window area. 5. The applicant shall comply with any and all restrictions placed on the liquor license by the Department of Alcoholic Beverage Control. 6. CUP 10-88 is non-transferrable. 7. No sales of alcoholic beverages shall take place between the hours of 2:00 a.m. to 6:00 a.m. 8. Conditional Use Permit 10-88 shall be approved for a period of one year at which time ~ the Planning Commission may consider extending the permit indefinitely, provided all conditions of approval have been satisfied, and no significant police incidents have occurred. 9. wi th the appl icant I s consent, the hours of operation shall be 24-hours a day, seven days a week.
