RESOLUTION No. 1523
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SEAL BEACH APPROVING
CONDITIONAL USE PERMIT 9-88, THE
REBUILDING OF AN EXISTING GASOLINE
STATION TO INCLUDE A SNACK SHOP/GENERAL
SERVICE BUILDING, THREE (3) FUELING ISLANDS,
SIX (6) MULTI-HOSE DISPENSERS AND A COIN-
OPERATED CAR WASH AT 12240 SEAL BEACH BLVD.
The Planning Commission of the city of Seal Beach does hereby
resolve:
WHEREAS, On August 23, 1988, Brian Rechsteiner, territory
manager for Mobile Corporation, submitted an
application for Conditional Use Permit 9-88 to the
Department of Development Services.
WHEREAS, The applicant is requesting to demolish an existing
gasoline station and rebuild to include three (3)
fueling islands with canopies, a snack shop and a coin-
operated car wash. The applicant is also requesting to
sell beer and wine at the proposed snack shop for off-
site consumption. The proposed design will include the
elimination of the existing lube bays. The fueling
islands will require the installation of four (4)
10,000 gallon underground double-walled fiberglass
gasoline storage tanks with leak detectors.
WHEREAS, The property has no approved CUP for the construction
or remodel of the service station.
WHEREAS, The property is a rectangular parcel and, as shown in
the site plan submitted, contains 32,034.6 square feet
in land area with 165 feet of frontage on Seal Beach
Boulevard.
WHEREAS, In March 1987, the City Council of the City of Seal
Beach approved a lot line adjustment for this property
increasing the area to 35,470.05 square feet.
WHEREAS, The surrounding zoning and land uses are as follow:
North currently developed with single family
dwellings in the City of Los Alamitos.
South - C-2, General Commercial, currently developed
with a bank.
East - The Armed Forces Reserve Center in the City of
Los Alamitos.
West - C-2, General Commercial containing the Rossmoor
WHEREAS, a duly noticed Public Hearing was held on
October 19, 1988.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of
the City of Seal Beach does hereby approve Conditional Use Permit
9-88" subject to the following conditions:
1. That all development be in substantial accordance with
the plans submitted.
2. No alcoholic beverages shall be sold in conjunction
with tnis gasoline station.

3. All lighting shall be directed away from neighboring
properties and confined to the subject property.
Lighting plan shall be reviewed and approved by
Development Services Department.
4. The applicant shall comply with the city Engineer's
recommendations as follow:
A. Remove the existing iSland/raised median
(approximately 4' x 11') on the north side
of Rossmoor Center Way and Seal Beach Blvd.
Patch with A.C. pavement, set pull box to
grade and paint double yellow line in place.
B. Replace existing 10 feet signal pole on the
northwest and southeast corner of Rossmoor
Center Way and Seal Beach Boulevard intersection.
C. with the permission of Bixby Ranch Co. and subject
to obtaining an easement as described in paragraph
10, patch with A.C. pavement and slurry seal
existing private road and replace existing
ribbon gutter.
D. Accept all flows infringing upon the property
and conduct these flows to the approved drainage
carrier. Avoid branching of flows.
E. Mobile oil Corporation shall send a blueprint
of the proposed development to the Industrial
Wastewater Section of the county Sanitation
District for the County requirement and obtain
their approval.
F. Southern California Water District shall also
approve the plan and meet their requirement.
G. Mobile oil corporation shall send, by certified
mail, a blueprint to the State of California
Military Department, Los Alamitos Army Airfield
for their approval and the City shall receive a
letter of No Objection of the proposed
development.
H. Additional improvements not specified in this
condition shall be noted/shown in the Grading
Plan.
5. The site shall be maintained in a litter-free state as
mandated by section 2S-231S{F) of the Code of The City
of Seal Beach. 6. Displays of merchandise shall not
be ~ocated further than five (5') feet from the service
station building.

7. All landscaping shall be bounded by a six (6") curb
and shall be maintained in good condition.

shall be 24 hours per day, seven days per week.
9. A eight (S') foot masonry wall shall be constructed
along the northerly property line, aqjacent to the
Orange County flood control c~annel and neighboring
residences.

10. Prior to issuance of any permit, the applicant shall
produce a lease agreement or other legally binding
device, from the owners of the access easement located
at the southerly property line granting a permanent
right of ingress and egress to Mobile Oil corporation.
Failure to produce such agreement may cause revisions
to the site plan, which shall be considered by the
Planning Commission as an amendment to this CUP at a
duly noticed Public Hearing.
11. The applicant shall obtain the appropriate permits for
removal of the three (3) existing underground storage
tanks and one ( 1 ) waste oil deposit tank from the
Orange county Fire Department.
12. The applicant shall comply with all the requirements
imposed by the Orange County Health Care agency's tank
removal division.
13. The site shall be tested in conformance with state laws
and agencies with a report forwarded to the City of
Seal Beach attention to the Director of Development
Services.
