RESOLUTION NO. 1524 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 11-87, A REQUEST TO EXTEND AN ON-SALE BEER AND WINE LICENSE IN CONJUNCTION WITH A RESTAURANT/DELICATESSEN KNOWN AS THE SEASIDE DELI, LOCATED AT 2938 WESTMINSTER BOULEVARD, SEAL BEACH WHEREAS, A duly noticed Public Hearing was held on November 16, 1988. WHEREAS, On October 13, 1987, Juliet B. vidanes submitted an application for Conditional Use Permit 11-87 to the Department of Development Services. WHEREAS, The applicant requested approval of the transfer of an on-sale beer and wine license in conjunction with an existing restaurant/delicatessen located at 2938 westminster Avenue, Seal Beach, CA. WHEREAS, The subject of the CUP is the Seaside Deli, located in the First Federal Plaza, a mUltiple-tenant center located at the southwest corner of the intersection of Seal Beach Boulevard and westminster Avenue. The Seaside Deli provides hot and cold food for consumption on-site or to go. WHEREAS, The surrounding land uses and zoning are as follows: NORTH - A mix of commercial and residential uses in the C-1 (Service commercial, C-2 (General commercial) and RHD (Residential High Density) zones. SOUTH AND EAST - Land belonging to the united States Naval Weapons station in the PLU (Public Land Use ) zone. WEST Light manufacturing in the M-1 (Light Manufacturing) zone. WHEREAS, The applicants restaurant/delicatessen as improvements. have maintained the is, making only cosmetic WHEREAS, The hours of operation Monday - Friday Saturday Sunday are: 9:00 a.m. 9:00 a.m. Closed to 7:00 p.m. to 6:00 p.m. WHEREAS, On March 4, 1981, the Planning Commission adopted Resolution Number 1221 approving Conditional Use Permit 1-81 for on-sale beer and wine at 2938 westminster Avenue. Three conditions were attached to CUP 1-81 as follows: A. CUP 1-81 is for on-sale beer and wine only at 2938 westminster Avenue. B. CUP 1-81 is non-transferrable. C. CUP 1-81 is issued for a period of one year; renewal at the end of the year with Commission approval. WHEREAS, William Stearns, Chief of Police, has reviewed the existing records, and has no reservations about permitting the operation to continue. . -- Page 2 of 2 City of Seal Beach Resolution No. 1524 WHEREAS, Staff inspection of the subject property revealed the existence of a satellite dish antenna for which there is no building permit. This is in direct violation of Seal Beach Municipal Code section 28-2350 relating to the regulation of satellite dish antennae in the City of Seal Beach. The applicant has been notified of this fact. NOW THEREFORE BE IT RESOLVED that the Planning commission of the city of Seal Beach does hereby approve Conditional Use Permit 11-87 subject to the following conditions: 1. The applicant shall apply for the appropriate building permits for the existing satellite dish antenna and comply with all the provisions of Section 28-2350 within sixty (60) days of approval of the extension of this CUP. If the existing satellite dish antenna does not comply with City Code, it shall be required to be removed within the above specified time limit. 2. CUP 11-87 is approved for an on-sale beer and wine license at 2938 westminster Avenue and is issued to Juliet B. Vidanes. 3. All alcoholic beverages shall be consumed entirely wi thin the building, and none shall be sold as take- out. 4. There shall be no alcoholic beverages advertised in the window areas. 5. The applicant shall continue to comply with all restrictions placed on the license by the California Department of Alcoholic Beverage Control. 6. CUP 11-87 shall be automatically terminated if the operation is no longer maintained as a "bona fide eating place" as def ined by the State Department of Alcoholic Beverage Control. 7. CUP 11-87 shall be approved for a period of one (1) year, after which the Planning Commission may review the CUP and extend it indefinitely. This CUP is non- transferrable. 8. Wi th the applicant's consent, the hours of operation shall be from 6:00 a.m. to 10:00 p.m. seven (7) days per week.
