HomeMy WebLinkAboutPC Res 1525 - 1988-11-16 . -.- ~ , ... , RESOLUTION 1525 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 12-88, A REQUEST TO APPROVE AN ON-SALE BEER AND WINE LICENSE IN CONJUNCTION WITH AN EXISTING RESTAURANT/DELICATESSEN KNOWN AS THE MAIN STREET DELI, LOCATED AT 303 MAIN STREET, SEAL BEACH WHEREAS, On November 16, 1988, a duly noticed Public Hearing was held. WHEREAS, On October 18, 1988, a representative of Bobkas Inc. submitted an application for Conditional Use Permit 12-88 to the Department of Development Services. WHEREAS, The applicant is requesting approval of a new Condi tional Use permi t for an on-sale beer and wine license in conjunction with an existing restaurant/delicatessen located at 303 Main Street in the City of Seal Beach. WHEREAS, The subject property is located on the west side of Main Street in the Seal Beach Mall, a ~ultiple tenant retail center, and is known as the Main Street Deli. WHEREAS, The surrounding land uses and zoning are as follows: NORTH, SOUTH and EAST - Additional businesses in the C-l, Service Commercial zone. WEST - Multiple-family residences in the RHD, Residential High Density zone. WHEREAS, The applicants are proposing to make me~u and decoration changes; no additional construction rs planned. WHEREAS, The hours of operation are: 9:00 a.m. 9:00 a.m. to 9:00 p.m. - to 10:00 p.m. - Sunday through Thursday Friday and Saturday WHEREAS, On 10-20-88, staff spoke with Mr. Saad Afif, owner of the Main Street Deli for the past six years, who indicated that he has no existing CUP with the City for a beer and wine license. He was not aware that the Ci ty routinely requires a Conditional Use Permit for the sale of alcoholic beverages. Mr. Afif does, however, possess an ABC license for the sale of beer and wine. The buyers, Rocky W. Gentner and Deborah Gentner of Bobkas Incorporated, are attempting to rectify this omission through the application of a new Conditional Use Permit. WHEREAS, William Stearns, Chief of Police, has reviewed the existing records and has no reservations about permitting this operation to continue. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 12- 88 subject to the following conditions: 1. Conditional Use Permit 12-88 is approved for an on-sale beer and wine license at 303 Main Street is issued to Bobkas, Incorporated. This CUP is non-transferr~ble. 2. All alcoholic beverages shall be consumed entirely within the bui,.lding, and none shall be sold as take- out. ~ . . .. Page 2 of 2 Resolution No. 1525 City of Seal Beach 3. There shall be no alcoholic beverages advertised in the window areas. 4. The applicant shall comply with all restrictions placed on the license by the California Department of Alcoholic Beverage Control. 5. CUP 12-88 shall be automatically terminated if the operation is no longer maintained as a "bona fide eating place" as defined by the state Department of Alcoholic Beverage Control. 6. CUP 12-88 shall be granted for a period of one (1) year, after which time the planning Commission shall review the CUP and may extend it indefinitely. 7. with the applicant's consent, the hours of operation shall be 9:00 a.m. to 9:00 p.m. Sunday through Thursday, and 9:00 a.m. to 10:00 p.m. Friday and Saturday.
