RESOLUTION NO. 1130 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING VARIANCE V-3-78 FOR THE CONSTRUCTION OF A PARKING STRUCTURE IN A PORTION OF A SIDEYARD SETBACK EXCEEDING THE MAXIMUM PERMITTED HEIGHT FOR AN ACCESSORY STRUCTURE. WHEREAS, an Application was duly filed by Robert Hirsch, a partner in the Rossmoor Park Apartments, 425 South Fairfax Ave., Los Angeles, for Variance V-3-78; and WHEREAS, the property is described as the Rossmoor Park Apartments, 12200 Montecito Road, Seal Beach. (Legal description on file); and WHEREAS, the proposal is to construct a parking structure in a portion of a sideyard setback, exceeding the maximum height permitted for an accessory structure; and WHEREAS, the Planning Commission makes the following findings regarding the application: 1. The granting of the variance will not adversely affect the General Plan because the use of the site, as a high density residential development, is consistent with the General Plan designation for the site. 2. The strict application of the zoning ordinance would deprive this property of privileges enjoyed by other property owners in the same vicinity and zone because (a) without the additional parking this development could not be converted into condominiums and all the adjoining properties are condominiums, (b) the site is presently developed and restricted in size so that there is very limited space for additional on-site parking, (c) the property is located in a developed area and there is no additional property that could be used to provide more parking for this project, and (a) another development in the immediate area was granted a variance to allow encroachments into yards and relief from the height limitations contained in the zoning ordinance. 3. The granting of the variance does not constitute a grant of speci'al privilege because the parking structure will be placed in a sideyard that is peesently occupied by carports and the height requirement is imposed by the Fire Department so that all of their safety vehicles will be able to pass through the parking structure at the lower level. . . . . e e .t . Resolution No. 1130 - 2 4. The parking structure will be Built at the property line where the existing carports are presently located. 5. The height of the parking structure at 19 feet will provide the Fire Department with the necessary clearance for emergency vehicles since the lower level of the structure will be depressed approximately four feet below grade to lessen the visual impact of the structure. 6. The zoning ordinance requirement for covered parking increases the height of the parking structure. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance V-3-78 subject to the approval of Conditional Use Permit CP-2-78 and Tentative Tract Map 10295.
