A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION RECOMMENDING TO CITY COUNCIL DENIAL OF AN APPEAL FOR A FENCE IN THE FRONT YARD SETBACK. WHEREAS, an application was duly filed by M. James Warnemuende, 305 Clipper Way, for Variance V-14-78; and WHEREAS, the property is described as Lot 47, Tract 6346, and is more commonly known as 305 Clipper Way; and WHEREAS, the proposal is for a fence in the front yard setback which exceeds the maximum permitted height; and WHEREAS, on September 20, 1978, the Planning Commission denied V-14-78, by Resolution No. 1166 on the basis that no hardship was demonstrated; and WHEREAS, the applicant filed an appeal, A-1-78, on the Planning Commission's denial; and . WHEREAS, on November 13, 1978, the City Council held a Public Hearing on A-1-78 and referred the matter back to the Planning Commission for further study; and WHEREAS, on December 6, 1978, the Planning Commission considered the appeal and made the following findings: 1. The fence was constructed without permits and in violation of City Codes. 2. No evidence was submitted to demonstrate specific hardship relating to the subject property. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby report to City Council that no additional evidence has been submitted that would demonstrate hardship and therefore, the Commission would reaffirm its denial of the Variance and recommend to City Council denial of the appeal.
