RESOLUTION NO. 1178
.
A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION
UPHOLDING A STAFF DENIAL OF A CONCEPT APPROVAL FOR
DEVELOPMENT AT 1200 PACIFIC COAST HIGHWAY.
WHEREAS, Signal Realty, P. O. Box 4016, Downey, California, requested
a concept approval of plans for construction of a 7-Eleven
Store and Winchell's Donut Shop; and
WHEREAS, the property is described as lots 66, 68, 70, 72 and 74,
Block 212, Bay View Tract and is more commonly known as
1200 Pacific Coast Highway; and
WHEREAS, on October 16, 1978, the Planning Department denied the concept
approval of the proposed project on the basis that previously
requested information and concerns expressed by the Commission
had not been provided and therefore it was not possible to
insure that the proposal conformed with the intent and provisions
of the zoning ordinance that ingress and egress and internal
circulation were arranged in a manner so as to avoid traffic
congestion and pedestrian and vehicular conflicts are minimized;

WHEREAS, the Staff denial of the concept approval was appealed to the
Planning Commission; and
WHEREAS, on November 15, 1978, the Planning Commission asked for a
response to the concerns as reflected by the following questions:
1. Would 7-Eleven consider reducing hours of
operation to something less than 24 hours?
2. What type of delivery vehicles are necessary
to service the proposed new stores?
3. What type of exterior lighting would be
installed and where would they be located?
4. How many employees would each use have on
an average work shift?
5. Provide information relating to problems of
cr~me on similar markets which are similarly
situated in other communities?
6. Information on pedestrian-vehicle conflicts
especially as it related to grammer school
children.
7. Determine from the residents in the immediate
area what perceived concerns they have
regarding residential and commercial compatibility;
and

WHEREAS, on December 20, 1978, information was presented to the Planning
Commission on the questions.stated above and the Commission
determined that the response represented inadequate information;
and

WHEREAS, the Planning Commission made the following findings:
1. The applicant failed to provide adequate information
on similar uses near schools in other cities.
2. Insufficient information was provided on perceived
community concerns regarding the proposed land use and its
compatibility with existing surrounding land uses; and
3. The safety of school children which would be compromised
.:by the proposed location and use.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby
uphold the Staff denial of the approval in concept for the 7-Eleven
Store and Winchell's Donut Shop, pending Commission determination that
the above concerns are adequately addressed.
