HomeMy WebLinkAboutPC Res 1189 - 1979-07-18 . . . e e RESOLUTION NO. 1189 A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING AND RECOMMENDING TO CITY COUNCIL APPROVAL OF PLANNED UNIT DEVELOPMENT PUD-1-79 FOR A 126-UNIT CONDOMINIUM PROJECT. WHEREAS, an application was duly filed by Golden Rain Foundation, P. O. Box 2069, Seal Beach, and Presley of Southern California, P. O. Box 2200, Newport Beach, for PUD-I-79; and WHEREAS, the property is described as a 5.51 acre site and is located at the southwest corner of Seal Beach Blvd., and Golden Rain Road (legal description on file with the City); and WHEREAS, the proposal is for a Planned Unit Development, PUD-I-79, for a 126-unit condominium project in the R-3 zone; and WHEREAS, an environmental assessment of the project has been completed and a Negative Declaration prepared which meets the requirements of CEQA; and WHEREAS, the Planning Commission makes the following findings regarding PUD-I-79: 1. The proposed use is consistent with the City's General Plan, Zoning Ordinance; 2. A Negative Declaration has been prepared for this project which did not reveal any major adverse impacts which cannot be mitigated; 3. The project is over two acres in size and is, therefore, eligible for consideration under a Planned Unit Development application; 4. NOW, THEREFORE, BE IT ,RESOLVED that the Planning Commission does 1. ~ .. \'" . hereby approve and recommends to C1ty Counc11 approval of PUD-I-79 subject to the following conditions: ( 1) . . . e e 1. Approval of PUD is subject to approval of Tentative Tract Map 10732. 2. Elevator design requirements to meet needs of handicapped and wheel chair occupants to satisfaction of City Fire Department. 3. Landscaping plans to be provided to Staff. Size and quantity of plants used to satisfy landscaping element of plan must be acceptable to City Engineer. g. The Covenants, Conditions and Restrictions for the project shall be submitted to the Staff and City Attorney for review and approval prior to recordation. CC&R's shall contain a provision that provides each unit with only one assigned covered parking space. 5. Glazing Code requirements be upgraded one step so that all windows indicating Code 3 would become Code 2 installations, all Code 2 windows shown would become Code 1. Code 1 windows shown would remain Code 1. 6. Developer shall comply with the accompanying conditions of Engineering, Fire and Police Departments Exhibit "A. II 7. The Planning Commission's recommendations for approval of the PUD is subject to the full in-lieu park fee being paid. If less than the full park fees are proposed to be collected, the project should be referred back to the Planning Commission for reassessment. Full in-lieu parkland fees are hereby determined to be a condition of Tentative Tract Map approval.
