RESOLUTION NO. 1206 A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION CONDITIONALLY APPROVING CONDITIONAL USE PERMIT, CP-6-80, FOR AN ON-SALE BEER AND WINE LICENSE FOR FAMILY AFFAIR RESTAURANT AT 115 MAIN STREET . WHEREAS, an application was duly filed by Carol Beck and Greg Halley, 115 Main Street for CP-6-80; and WHEREAS, the property is described as Lot 13 and 15, Block 8, Bay City Tract and is more commonly known as 115 Main Street; and WHEREAS, the proposal is for a Conditional Use Permit to allow on-sale beer and wine in conjunction with the existing Family Affair Restaurant at 115 Main Street; and WHEREAS, the Planning Commission makes the following findings: 1. The restaurant is located more than 300' from the nearest religious or educational facility; 2. The restaurant is within 300' of existing residences; 3. The Health Department and Building Department have found items needing correcting in the building. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve CP-6-80, subject to the following conditions: 1. CUP for on-sale beer and wine at 115 Main Street; 2. CUP issued is non-transferrable; 3. CUP is issued for a period of one year; renewal at the end of one year with Commission approval. 4. CUP shall not be issued until the corrections are made per the February 27, 1980 Building Department memorandum and Health Department report.
