" '. , ~ A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH, RECOMMENDING APPROVAL OF ZONE CHANGE 1-89, A REQUEST TO REZONE A PROPERTY ON FIRST STREET (ORANGE COUNTY ASSESSOR'S PARCEL NO. 043-313-01) FROM OIL EXTRACTION (OE) TO RESIDENTIAL MEDIUM DENSITY (RMD-4000). The Planning Commission of the City of Seal Beach does hereby resolve: WHEREAS, a request was filed by James Watson to amend the City'S zoning Map for the property shown in Exhibit "A", attached and described as Orange county Assessor's Parcel No. 043-313-01; and WHEREAS, the request is to change the zoning designation from oil Extraction (OE) to Residential Medium Density (RMD); and WHEREAS, the property is a 16,912 square foot property located south of existing two-story single family detached homes and north of the existing oil separation facility, and is currently used for boat storage; and WHEREAS, an application has been prepared for the requested Zone Change, and a duly noticed Public Hearing has been set for February 1, 1989; and WHEREAS, the land use and zoning surrounding the parcel for which Zone Change 1-89 is requested are as follows: North & East: Single family detached dwellings zones Residential Low Density (RLD) (3,000). West: Seal Beach Trailer Park and Riverbeach townhomes, both zoned Residential High Density (RHD). Existing Exxon oil separation facility, zoned oil Extraction (OE); and WHEREAS, the Planning Commission recommends to the City council that a density suffix of 4,000 be added to the RMD, requiring one unit for each 4,000 square feet; and South: WHEREAS, the City requires the property owner to enter into an agreement with the City and recorded on the property in the favor of the City of Seal Beach limiting the height on the property to twenty-five feet (25')/two stories, except for the southerly one-half thereof upon which a maximum height of thirty- five feet (35') shall be permitted on condition that no structure shall. have more than two stories of living space and the architecture of the roofs shall be of the style presented at the Planning Commission meeting of March 1, 1989 or equivalent thereof. WHEREAS, a rezoning of the parcel in question to RMD-4000 with the subject agreement is compatible with the surrounding residential land uses; and e . '" ..-- , ." , ,.r Page 2 of 2 Resolution No. 1528 City of Seal Beach WHEREAS, Zone Change 1-89 will not cause any adverse environmental impact as shown in the initial study for Negative Declaration 1-89, and therefore, the Planning Commission recommends adoption of this Negative Declaration to the City Council; and WHEREAS, the Planning Commission has adopted Resolution No. 1527, recommending to the city Council that General Plan Amendment 1-89 be adopted, changing the land use designation from oil Extraction to Medium Density Residential; and WHEREAS, Zone Change 1-89 will not adversely impact the health, safety and general welfare of the surrounding community. NOW, THEREFORE, BE IT RESOLVED that the Planning commission of the City of Seal Beach does hereby approve and recommend to the City Council Zone Change 1-89, as shown in Exhibit "A", attached.
