HomeMy WebLinkAboutPC Res 1532 - 1989-03-15 .. . . *1)" .L/9/?'J ;:'SI:>AJ RESOLUTION NUMBER 1532 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 14-88, A REMODEL OF AN EXISTING GASOLINE STATION TO INCLUDE MODIFICATIONS TO THE ISLAND PUMP CANOPY, REPLACEMENT OF DISPENSERS, NEW LIGHT FIXTURES, AND MINOR INTERIOR IMPROVEMENTS The planning Commission of the city of Seal Beach does hereby resolve: WHEREAS, on December 12, 1988, Jane Keith, on behalf of Mobil oil Corporation, submitted an application for Conditional Use Permit 14-88 to the Department of Development Services; and WHEREAS, the applicant is requesting to remodel existing canopies to a thirty (30) inch fascia, remove existing yard lights and install new 400 watt lights, remove existing pump islands and dispensers, and replace with new islands and dispensers, minor interior improvements, and install "mobile" legends on the canopy; and WHEREAS, the property has no approved CUP for the construction or remodel of the service station; and WHEREAS, the property is a rectangular parcel, and contains a total of 22,112 square feet, which requires a variance from the city's Code provisions, and the applicant has filed a variance (Var 1-89); and WHEREAS, the surrounding zoning and land uses are as follows: North - the Los Alamitos Armed Forces Resource Enter (AFRC) . South & East - West - Residential townhome complex zoned RMD. The Bixby Tennis Club zoned C-2, and; WHEREAS, a duly noticed public hearing was held on March 15, 1989; and WHEREAS, this project is categorically exempt from the requirements of the California Environmental Quality Act (California Administrative Code section 15301); and WHEREAS, the Planning Commission makes the following findings: 1. That the proposed project is in conformance with the General Plan of the City of Seal Beach. 2. That the proposing improvements are wi thin the scope of permitted uses shown in the City's service station guidelines. 3. That with conditions in place, the use will be compatible with surrounding uses, and will not be a detriment. 4. That certain site development standards, such as parking and signage, will be brought into ~ conformance. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 14-88, subject to the following conditions: 1. That the final development plans shall be in substantial accordance with the plans submitted. Site plan will be revised to include a total of eight (8) parking specs. ~ . e Page 2 of 2 - Resolution Number 1532 2. The owner shall be responsible for the construction, reconstruction, or replacement of any missing or damaged public improvements, including street trees. 3. All lighting shall be designed and located so as to confine direct rays to the subject property. Prior to building permit issuance, owner shall submit documentation that new light fixtures shall meet the specific intent of this condition. Use of buffering or sharp cut-off fixtures are acceptable approaches. 4. Displays of merchandise shall not be located further than five (5) feet from the service station building. The site shall be maintained in a litter free state as mandated by section 28- 2318{f) of the Code of the City of Seal Beach. 5. All landscaping shall be maintained in a good condition. 6. The applicant shall obtain the appropriate permits to install new dispensers plus new fiberglass lines to existing underground fuel tanks. 7. If ground contamination is found, a final clean-up report shall be forwarded to the City of Seal Beach. 8. A sign permit shall be required before any signs can be constructed. The request for the "Mobile" canopy sign is denied until such time that a sign program in full conformance with code provisions is submitted and approved by the Department of Development Services. Sign program shall be submitted and approved prior to building permit issuance and all non-conforming signage shall be removed. 9. A trash enclosure shall be required to the satisfaction of staff and approved by the Planning Department.
