RESOLUTION NUMBER 1536 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING AN INDEFINITE EXTENSION TO CONDITIONAL USE PERMIT 2-88, A REQUEST TO PERMIT THE SALE OF BEER AND WINE IN CONJUNCTION WITH A NEW RESTAURANT (3001 OLD RANCH PARKWAY) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, On February 8, 1988, Lawrence R. Cooper filed an application for Conditional Use Permit 2-88 on behalf of the Souper Corporation, with the Department of Development Services; and WHEREAS, The applicant requested approval for the sale of beer and wine in conjunction with a new restaurant located at 3001 Old Ranch Parkway; and WHEREAS, The subject property is located within the Bixby Office Park, a multiple-tenant, mixed use project located at Seal Beach Boulevard and the I-405 freeway; and WHEREAS, The surrounding land uses and zoning are as follows: NORTH A flood control channel and single family homes located in Rossmoor, an unincorporated community in the County of Orange. SOUTH The Beverly Manor reservoir and fire station, separated fram the subject property by the I-405 freeway. EAST A service station in the C-2 (General Commercial) Zone, separated fram the subject property by Seal Beach Boulevard. WEST Office buildings within the Bixby Office Park; and WHEREAS, on September 8, 1987, the City Council approved the precise plans for The Soup Exchange, including floor plans, parking, architecture and restaurant concept; and WHEREAS, the hours of operation are as follow: Daily 11:00 a.m. to 9:30 p.m.; and WHEREAS, Chief of Police William Stearns has reviewed the existing records, and has no reservations about permitting the operation to continue; and WHEREAS, The Planning Commission of the City of Seal Beach took action at their regularly scheduled meeting of March 16, 1988, to approve Conditional Use Permit 2-88'subject to eight conditions; and WHEREAS, One of the conditions stated that CUP 2-88 would be granted for twelve (12) months, after which time the Planning Commission would review the CUP, and could extend it indefinitely; and WHEREAS, this resolution amends Resolution Number 1500; and WHEREAS, a duly noticed public hearing was held on Wednesday, April 5, 1989. ~ . ,~ . . .. Page 2 of 2 Resolution No. 1536 City of Seal Beach NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 2-88, subject to the following conditions: 1. CUP 2-88 is approved for an on-sale beer and wine license at 3001 Old Ranch Parkway and is issued to Souper Corporation, d/b/a The Soup Exchange. 2. All alcoholic beverages shall be consumed entirely within the building, and none shall be sold as take-out. 3. No video games or similar amusements shall be permitted on the premises. 4. There shall be no alcoholic beverages advertised in the window areas. 5. The applicant shall comply with all restrictions placed on the license by the California Department of Alcoholic Beverage Control. 6. CUP 2-88 shall be automatically terminated if the operation is no longer maintained as a "bona fide eating placell as defined by the State Department of Alcoholic Beverage Control. 7. CUP 2-88 is non-transferrable. 8. With the applicant's consent, the hours of operation shall be from 11:00 a.m. to 9:30 p.m. daily.
