HomeMy WebLinkAboutPC Res 1537 - 1989-04-05 .... :., e e ~ J">- RESOLUTION NUMBER 1537 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING AN INDEFINITE EXTENSION TO CONDITIONAL USE PERMIT 3-88, A REQUEST TO TRANSFER AN ON- SALE GENERAL LIQUOR LICENSE IN CONJUNCTION WITH THE SALE OF AN EXISTING RESTAURANT (620 PACIFIC COAST HIGHWAY) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, On February 24, 1988, General Mills Restaurants, Inc., d/b/a Red Lobster, filed an application for Conditional Use Permit 3-88 with the Department of Development Services; and WHEREAS, The applicant requested approval for the transfer of an on-sale general liquor license in conjunction with the sale of Seafood Broiler at 620 Pacific Coast Highway; and WHEREAS, The subject property is located within the Bay City Center, a multiple-tenant commercial center located on Pacific Coast Highway between 5th Street and Marina Drive; and WHEREAS, The surrounding land uses and zoning are as follows: NORTH & WEST A mix of commercial and single family residential uses in the C-2 (General Commercial) and the Residential Low Density (RLD) zones. SOUTH A mix of commercial and residential uses in the C-2 (General Commercial) and the Residential High Density (RHD) zones. EAST Single family residential uses in the RLD zone; and WHEREAS, the applicant proposed a minor remodel to the restaurant to change the kitchen equipment and to change the fish market into additional waiting area. otherwise, the restaurant remained as is; and WHEREAS, the hours of operation are as follow: Sunday through Thursday, 11:30 a.m. to 10:00 p.m., and Friday and Saturday, 11:30 p.m. to 11:00 p.m.; and WHEREAS, Chief of Police William Stearns has reviewed the existing records, and has no reservations about permitting the operation to continue; and WHEREAS, The Planning Commission of the City of Seal Beach took action at their regularly scheduled meeting of March 16, 1988, to approve Conditional Use Permit 3-88 subject to eight conditions; and WHEREAS, One of the conditions stated that CUP 3-88 would be granted for twelve (12) months, after which time the Planning Commission would review the CUP, and could extend it indefinitely; and WHEREAS, this resolution amends Resolution Number 1501; and WHEREAS, a duly noticed public hearing was held on Wednesday, AprilS, 1989. ~ - ~ v '. . . ).J . e Page 2 of 2 Resolution No. 1537 City of Seal Beach NOW, THEREFORE BE IT RESOLVED that the Planning Comnission of the City of Seal Beach does hereby approve Conditional Use Permit 3-88, subject to the following conditions: 1. CUP 3-88 is approved for an on-sale beer ,wine and distilled spirits license at 620 Pacific Coast Highway, and is issued to General Mills Restaurants, Inc., d/b/a Red Lobster. 2. All alcoholic beverages shall be consumed entirely within the building, and none shall be sold as take-out. 3. No video games or similar amusements shall be permitted on the premises. 4. There shall be no alcoholic beverages advertised in the window areas. 5. The applicant shall comply with all restrictions placed on the license by the California Department of Alcoholic Beverage Control. 6. CUP 3-88 shall be automatically terminated if the operation is no longer maintained as a "bona fide eating place" as defined by the State Department of Alcoholic Beverag~ Control. 7. CUP 3-88 is non-transferrable. 8. With the applicant's consent, the hours of operation shall be Sunday through Thursday, 11:30 a.m. to 10:00 p.m., and Friday and Saturday, 11:30 a.m. to 11:00 p.m. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 5th day of April, 1989, by the following vote: AYES: Conunissioners Rullo, Suggs, Sharp, Fife.
