RESOLUTION NUMBER 1542
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING VARIANCE
5-89, A REQUEST TO ALLOW FOR THE PROVISION
OF A ZERO FOOT SIDE YARD SETBACK; IN
CONJUNCTION WITH THE ESTABLISHMENT OF A NEW
SINGLE FAMILY HOME AT THE CORNER OF ELEVENTH
STREET AND LANDING AVENUE, AT THE SITE
COMMONLY REFERRED TO AS THE "BUS BARN"

THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:
WHEREAS, On April 12, 1989, Eunice and Nancy Mc Mullen filed an
application with the Department of Development Services for
Variance 5-89, a request to deviate from Section 28-801 of the
Code, which requires a minimum three (3) foot side yard setback
in the Residential High Density zone, (RHO), and allow for the
provision of a zero foot side yard setback; in conjunction with
the construction of a new single family home at the corner of
11th Street and Landing Avenue, at the site commonly referred to
as the "Bus Barn;" and
WHEREAS, The subject property, Orange County Assessor's map book 43 block
122 parcel 34, contains 25 feet of frontage on 11th Street, and
a depth of 117.5 feet; and
WHEREAS, The subject property was rezoned to Residential High Density
from Public Land Use in March of 1987, by the approval of Zone
Change 2-87; and
WHEREAS, The subject property contains approximately 2,938 square feet
and is located on the west side of 11th Street; and
WHEREAS, The subject property currently contains a one-story structure,
formerly used as a "bus barn" for the Seal Beach School
District; and
WHEREAS, The surrounding land use and zoning are as follows:
NORTH
City-owned bleachers and softball diamond in the
Public Land Use zone, (PLU).
SOUTH, EAST
AND WEST
Single and multiple family units in the
Residential High Density zone, (RHO); and
WHEREAS, The Planning Commission makes the following findings:
1. Variance 5-89 will not adversely affect the General Plan
which designates the subject property for residential
uses.
2. There are special property related circumstances which
deprive the property at 143 Main Street of the privileges
enjoyed by other property in the same vicinity and zone.
Specifically, due to the property's location, directly
adjacent to the City's softball bleachers, the required
three (3) foot side yard setback would result in a hardship
on the property. Accumulation of litter and noise from the
adjacent bleachers would cause this hardship.
3. Due to the unique situation of the subject property, the
granting of Variance 5-89 will not constitute a granting of
special privilege inconsistent with other limitations upon
other properties in the same vicinity and zone.

NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of
Seal Beach does hereby approve Variance 5-89, subject to the following
conditions:
1. Variance 5-89 is approved to allow for the deviation fram Section 28-
801 of the Code, which requires a minimum three (3) foot side yard
setback in the Residential High Density zone, (RHO), and allow for
the provision of a zero foot side yard setback; in conjunction with
the construction of a new single family home at the corner of 11th
Street and Landing Avenue, at the site commonly referred to as the
"Bus Barn."
2. Subsequent construction documents shall be in substantial compliance
with the plans approved through Variance 5-89.
3. The proposed residence shall maintain an average setback of six (6)
feet on the south side of the property, while providing a minimum
setback of three (3) feet.
4. The block wall on the north side of the residence shall be painted
and maintained with a graffiti-proof paint or sealant, to the
satisfaction of the Department of Development Services.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of
Seal Beach at a meeting thereof held on thel~th day of May, 1989, by the
following vote:
