HomeMy WebLinkAboutPC Res 1543 - 1989-05-17 ., .~ e e ., RESOLUTION NUMBER 1543 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 3-89, A REQUEST TO UPGRADE AN EXISTING ON-SALE BEER AND WINE LICENSE TO A GENERAL LIQUOR LICENSE IN CONJUNCTION WITH AN EXISTING RESTAURANT (PRIM ROSE FAMILY RESTAURANT 2940 WESTMINSTER AVENUE, SEAL BEACH) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, On April 10, 1989, Farshid Tahvildari filed an application for Conditional Use Permit 3-89 on behalf of Prim Rose Family Restaurant, with the Department of Development Services; and WHEREAS, The applicant requested approval to upgrade an existing on-sale beer and wine license to a general liquor license in conjunction with an existing restaurant at 2940 Westminster Avenue, Seal Beach (Prim Rose Family Restaurant); and WHEREAS, The subject property is located in a commercial center situated at the southwest corner of the intersection of Seal Beach Boulevard and Westminster Avenue; and WHEREAS, The surrounding land use and zoning are as follows: NORTH The Leisure Center in the Service Commercial (C-l) zone. EAST An existing service station in the General Commercial (C-2) zone. SOUTH Seal Beach Naval Weapons Center in the Public Land Use (PLU) zone. WEST Rockwell International in the Light Manufacturing (M-I) zone; and WHEREAS, The Planning Commission of the City of Seal Beach took action at their regularly scheduled meeting of July 7, 1982, to approve Conditional Use Permit 6-82 subject to two conditions: 1. CUP is approved for on-sale beer and wine at 2940 Westminster Avenue and issued to Farshid and Nader Tahvildari. 2. CUP is approved for one year with option to apply for renewal at the end of one year; and WHEREAS, William Stearns, Chief of Police, has reviewed the existing records, and has no reservations about permitting the upgrade to a general liquor license; and WHEREAS, the Planning Commission makes the following findings: 1. The service of beer, wine and distilled spirits in conjunction with the existing restaurant at 2940 Westminster Avenue will not impact the surrounding neighborhood. The subject property has possessed an on- sale and off-sale beer and wine license for the past seven years with no reported impacts. The subject property is surrounded on two sides by commercial uses in the Service Commercial zone, (C-l), and General Commercial zone, (C-2). Rockwell International in the Light Manufacturing zone, (M- 1), and the Seal Beach Naval Weapons Center in the Public Land Use zone, (PLU) surround the subject property on the remaining two sides. , ...., '# ,# . e City of Seal Beach Planning Commission Resolution 1543 Page 2 of 2 2. The service of beer, wine and distilled spirits is appropriate for the existing restaurant on the subject property. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 3-89, subject to the following conditions: 1. CUP 3-89 is approved for an on-sale beer, wine and distilled license at 2940 Westminster Avenue and is issued to Farshid Tahvildari, on behalf of the Prim Rose Family Restaurant. 2. All alcoholic beverages shall be consumed entirely within the building, and none shall be sold as take-out. 3. No video games or similar amusements shall be permitted on the premises. 4. There shall be no alcoholic beverages advertised in the window areas. 5. The applicant shall comply with all restrictions placed on the license by the California Department of Alcoholic Beverage Control. 6. CUP 3-89 shall be automatically terminated if the operation is no longer maintained as a "bona fide eating place" as defined by the State Department of Alcoholic Beverage Control. 7. CUP 3-89 is non-transferrable. 8. With the applicant's consent, the hours of operation shall be fram 6:00 a.m. to 9:00 p.m, daily. 9. The term of this permit shall be for twelve (12) months, after which time the Planning Commission may extend the permit indefinitely provided that all conditions of approval have been satisfied, and no significant police problems have occurred. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 17th day of May, 1989, by the following vote: AYES: Commissioners Sharp, Suggs, Jessner, Rullo NOES: Commissioners Fife ABSENT: Commissioners ABSTAIN: Commissioners BCC: bec
