RESOLUTION NO. 1544
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
SEAL BEACH, RECOMMENDING ALTERNATIVE B.2 OF THE
MOLA DEVELOPMENT CORPORATION TO THE CITY COUNCIL
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, a request was filed by Mala Development corporation to
amend the existing Hellman specific Plan prepared and
adopted in December of 1987; and
WHEREAS, the City Council has held public hearings on the
proposed plan which covers the establishment, policies,
regulations, and processing of the specific Plan; and
WHEREAS, the City Council has directed the Planning Commission
to consider alternatives to the proposed plan; and
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Seal Beach does hereby recommended approval of the
al ternati ve B. 2 to the Hellman Specific Plan for the Hellman
Ranch area with the following five (5) modifications in place and
with the assumption that all conditions that were part of the
original plan approved last fall which were not affected by the
change in design (safety improvements on First Street, noise
mitigation studies, buried atomic waste etc.) are included in the
B.2 alternative plan:
1. Covenants, Conditions and Restrictions (CC&R's) for the
project would require that for a period of sixty (60)
days prior to any election in which p~lls will be open
in the City of Seal Beach and while any initiative or
referendum petition is on file with the Office of the
Ci ty Clerk for circulation wi thin the City of Seal
Beach, that any person would be admitted through any
gate wi thin the community with or without a vehicle
during the same hours of the day that polls would be
open (if that were an election day) for the purposes of
conducting political activity upon simply identifying
him/herself and stating his/her purpose is to conduct
political activity. This provision shall not be
subject to amendment or termination by the owners
within the gated community.
2. That the deeds and sales literature would affirmatively
disclose to prospective buyers that the development
area includes significant geological hazards, including
unmapped earthquake faults and soils subject to
liquefaction.
3. The developer shall grade the wetlands designated area
and extract therefrom as much of the fill material as
is required for the rest of the project as may feasibly
be extracted from the wetlands area and shall commit up
to $50,000 for completion of needed or advisable
wetlands restoration studies.
4. Items numbered IV.B. and IV.C of the Mola Development
Corporation letter dated 6/14/89 as presented to the
Planning Commission this evening shall be eliminated:

IV. Funding of Park Improvements

B. City of Seal Beach Redevelopment Agency
will reimburse the Developer through tax
increments for the cost of improvements
(exclusive of Gum Grove Park
Improvements) over a period of ten
years.
1. Payments will start one year
after completion of the 346th
unit.
C. Approximate payments:
Assuming $1.8 million improvement
costs with 7.5% interest rate
amortized over ten (10) years will
require payments of $256,000 per
year.
And that the provisions of this letter are otherwise
part of the B.2 plan.
5. The first lot on Pacific Coast Highway and First Street
would be split between the adjacent lot and an entry
plot with appropriate signage to announce the entry to
the community.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting held on the 14th day of
June, 1989 by the following vote:

Dear Mr. Sharp:
Attached please find Mola Development Corporation's proposal for
the implementation of the Hellman Ranch Community Park System. Our
Company shares the Commission's concerns as to the implementation
and maintenance of'this System. We feel this proposal satisfies
both of these coneerns.
We will discuss this proposal at tonight's Planning Commission
meeting and we are looking forward to a favorable response.

IV. Funding Of Park Improvemen'ts
A. Park Improvements will be built in two Phases and Funded
by Mola Development.
B. City of Seal Beach Redevelopment Agency will reimburse
the Developer through t,ax increments for the cost of
improvements (exclusive of Gum Grove Park Improvements)
over a period of ten years.
1. Payments will start One Year after completion of
the 346th unit.
C. Approx~mate payments:
Assuming $1.8 million improvement costs with
7.5% interest rate amortized over 10 years
will require payments of $256,500 per year.
V. Dedication of Parkland
A. City of Seal Beach has established a standard of Five
Acres of local Parkland for every 1,000 residents. B-2
Plan will generate a population of 1,211 residents,
therefore a 6.06 Acre Dedication is required for this
Project. Mola Development will dedicate without charge
to the ci ty , a total of approximately 25 Acres of
Parkland on this Project.
VI. Maintenance of Parkland
A. Mola Development will purchase an annuity or like
instrument which will guarantee to the City of Seal
Beach the required maintenance funds for this Park for
a term of ten years. The goal would be to provide
through this annuity money for park maintenance costs.
This will not be reimbursed through III above, but will
be a contribution to the City.
VII. Development Agreement
A. The above listed programs would be written into a
Development Agreement between the City and Developer to
insure implementation of the Public Park Program for
this Project.
