HomeMy WebLinkAboutPC Res 1546 - 1989-07-05 1f ....... e . ..... <<: RESOLUTION NUMBER 1546 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 6-89, A REQUEST TO RECONSIDER THE ORIGINAL CONDITIONS OF APPROVAL OF CONDITIONAL USE PERMIT 9-88, WHICH WAS A REQUEST TO PERMIT THE REBUILDING OF AN EXISTING GASOLINE STATION TO INCLUDE A SNACK SHOP/ GENERAL SERVICE BUILDING, THREE (3) FUELING ISLANDS, SIX (6) MULTI-HOSE DISPENSERS AND A COIN OPERATED CAR WASH AT 12240 SEAL BEACH BOULEVARD (MOBIL OIL) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, On May 15, 1989, Mobil Oil Corporation submitted an application for Conditional Use Permit 6-89 to the Department of Development Services; and WHEREAS, The subject property received Planning Commission approval for Conditional Use Permit 9-88, a request to demolish an existing gasoline station and rebuild to include three (3) fueling islands with canopies, a snack shop and a coin operated carwash. Additionally, the request called for the removal of the existing lube bays, and the installation of four (4) 10,000 gallon underground, double-walled, fiberglass gasoline storage tanks with leak detectors. CUP 9-88 was approved subject to fourteen (14) conditions; and WHEREAS, The applicant is specifically requesting the reconsideration and removal of condition * 10 of Planning Commission Resolution 1523 which states: 10. Prior to issuance of any permit, the applicant shall produce a lease agreement or other legally binding device, fram the owners of the access easement located at the southerly property line granting a permanent right of ingress and egress to Mobil Oil Corporation. Failures to produce such an agreement may cause revisions to the site plan, which shall be considered by the Planning Commission as an amendment to this CUP at a duly noticed public hearing; and WHEREAS, The subject property is a rectangular parcel and, as shown in the site plan submitted, contains 34,035 square feet in land area with 165 feet of frontage on Seal Beach Boulevard; and WHEREAS, In March 1987, the City Council approved a lot line adjustment for this property, increasing its area to 35,470.5 square feet; and WHEREAS, The surrounding land use and zoning are as follows: NORTH Single family dwellings located in the City of Los Alamitos. SOUTH A bank located in the General Commercial zone, (C-2) . EAST The Armed Forces Reserve Center located within the City of Los Alamitos. WEST Commercial buildings located in the Rossmoor Center located in the General Commercial zone, (C-2); and WHEREAS, A duly noticed public hearing was held on Wednesday July 5, 1989. \ .. '- .. . 4. City of Seal Beach Planning Commission Resolution No. 1546 Page 2 of 3 NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 6-89, subject to the following conditions: 1. That all development be in substantial accordance with the plans submitted. 2. No alcoholic beverages shall be sold in conjunction with this gasoline station. 3. All lighting shall be directed away from neighboring properties and confined to the subject property. Lighting plan shall be reviewed and approved by Development Services Department. 4. The applicant shall comply with the City Engineer's recommendations as follows: A. Replace existing 10 feet signal pole on the northwest and southeast corner of Rossmoor Center Way and Seal Beach Boulevard intersection. B. With the permission of Bixby Ranch Co., patch with A.C. pavement and slurry seal existing private road and replace existing ribbon gutter. C. Accept all flows infringing upon the property and conduct these flows to the approved drainage carrier. Avoid branching of flows. D. Mobile Oil Corporation shall send a blueprint of the proposed development to the Industrial Wastewater Section of the County Sanitation District for the County requirement and obtain their approval. E. Southern California Water District shall also approve the plan and meet their requirement. F. Mobile Oil Corporation shall send, by certified mail, a blueprint to the State of California Military Department, Los A1amitos Army Airfield for their approval and the City shall receive a letter of No Objection of the proposed development. G. Additional improvements not specified in this condition shall be noted/shown in the Grading Plan. 5. The site shall be maintained in a litter-free state as mandated by Section 28-2318(F) of the Code of The City of Seal Beach. 6. Displays of merchandise shall not be located further than five (5') feet from the service station building. 7. All landscaping shall be bounded by a six (6") curb and shall be maintained in good condition. 8. With the applicant's consent, the hours of operation shall be 24 hours per day, seven days per week. ~\ l .. e . .. City of Seal Beach Planning Commission Resolution No. 1546 Page 3 of 3 9. A eight (8') foot masonry wall shall be constructed along the northerly property line, adjacent to the Orange County flood control channel and neighboring residences. 10. The applicant shall obtain the appropriate permits for removal of the three (3) existing underground storage tanks and one (1) waste oil deposit tank fram the Orange County Fire Department. 11. The applicant shall comply with all the requirements imposed by the Orange County Health Care agency's tank removal division. 12. The site shall be tested in conformance with State laws and agencies with a report forwarded to the City of Seal Beach attention to the Director of Development Services. 13.
