RESOLUTION NUMBER 1551
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING CONDITIONAL
USE PERMIT 9-89, A REQUEST FOR AN OFF-SALE
GENERAL LIQUOR LICENSE IN CONJUNCTION WITH
THE TRANSFER OF OWNERSHIP OF AN EXISTING
LIQUOR STORE LOCATED AT 462 PACIFIC COAST
HIGHWAY (WEST BEACH LIQUOR)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:
WHEREAS, On July 31, 1989, Betty Nobriga submitted an application for
Conditional Use Permit 9-89 to the Department of Development
Services, a request to transfer an existing off-sale general
liquor license, in conjunction with the transfer of ownership of
an existing liquor store located at 462 Pacific Coast Highway,
Seal Beach. (West Beach Liquor); and
WHEREAS, The subject property is located within the PCH Plaza, a small
commercial center located on the southwest corner of Pacific
Coast Highway and Fifth Street; and
WHEREAS, The property has approximately 218 feet of frontage on Pacific
Coast Highway and a depth varying from 26 feet to 170 feet; and
WHEREAS, The subject property contains approximately 2,500 square f~et of
floor area, and is therefore required to provide nine (9)
parking spaces. The subject property provides all nine (9) of
the required parking spaces on-site; and
WHEREAS, The subject property contains an existing liquor store (West
Beach Liquor), which currently possesses a valid alcoholic
beverage license for off-sale beer, wine and distilled spirits
(approved originally through CUP 6-81, and transferred once
previously through CUP 10-85); and
WHEREAS, Conditional Use Permits are non-transferrable. The ownership
change of West Beach Liquor therefore requires review of the
operation by the Planning Commission and approval of a new CUP;
and
WHEREAS, The applicant is specifically requesting CUP 9-89 in order to
permit the continuing operation of an existing liquor store
which has changed ownership; and
WHEREAS, There are no schools or churches located within 600 feet of the
subject property; and
WHEREAS, That the applicant's proposed hours of operation are:
8:00 a.m. to 12:00 a.m. (midnight), Daily; and
WHEREAS, William Stearns, Chief of Police, has reviewed the proposal and
existing records, and has no reservations about allowing the
proposed use; and
WHEREAS, The surrounding land use and zoning are as follows:
NORTH, SOUTH Existing commercial businesses in the General
Commercial zone, (C-2).
WEST, EAST Single family dwelling units in the Residential
Low Density zone, (RLD); and
WHEREAS, A duly noticed public hearing was held on September 6, 1989; and

NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of
Seal Beach does hereby approve COnditional Use Permit 9-89, subject to the
following conditions:
1. CUP 9-89 is approved for off-sale general liquor, in conjunction with
the transfer of ownership of an existing liquor store located at 462
Pacific Coast Highway, Seal Beach (West Beach Liquor).
2. That all alcoholic beverages shall be consumed entirely off the
premises.
3. That the applicant shall comply with all restrictions placed upon the
license by the State Department of Alcoholic Beverage Control.
4. No video games or similar amusements shall be permitted on the
premises.
5. That the CUP 9-89 is non-transferrable.
6. That there shall be no alcoholic beverage advertising display devices
located in the window areas.
7. With the applicant's consent, the hours of operation shall be from
8:00 a.m. to 12:00 a.m Sunday through Thursday and 8:00 a.m. to 2:00
a.m. Friday and Saturday.
8. The term of this permit shall be for twelve (12) months, after which
time the Planning Commission may extend the permit indefinitely
provided that all conditions of approval have been satisfied, and no
significant police problems have occurred.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of
Seal Beach at a meeting thereof held on the 6th day of September, 1989, by
the following vote:
