HomeMy WebLinkAboutPC Res 1553 - 1989-09-20 e . ~ , RESOLUTION NUMBER 1553 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING A TWELVE (12) MONTH EXTENSION OF CONDITIONAL USE PERMIT 7-88, A REQUEST FOR AN OFF-SALE GENERAL LIQUOR LICENSE IN CONJUNCTION WITH AN EXISTING LIQUOR STORE LOCATED AT 1780 PACIFIC COAST HIGHWAY (BAY LIQUOR) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, On August 15, 1989, staff notified Julius Dibsy that the renewal date had arrived for Conditional Use Permit 7-88. Staff informed the applicant that CUP 7-88 was granted for a period of one year and, in order to maintain a valid CUP for alcohol sales the applicant needed to renew his Conditional Use Permit; and WHEREAS, The applicant subsequently filed for an extension of CUP 7-88, which was originally a request to transfer an existing off-sale general liquor license in conjunction with an existing liquor store at 1780 Pacific Coast Highway (Bay Liquor); and WHEREAS, The subject property is located at the corner of Pacific Coast Highway and Seal Beach Boulevard, consisting of a three unit single story commercial center, of which the convenience store (liquor store) is the largest of the three units; and WHEREAS, The surrounding land uses and zoning are as follows: NORTH Across Pacific Coast Highway are single family homes in the Residential Low Density zone, (RLD). SOUTH The Shore Shop commercial center, located in the General Commercial zone, (C-2). EAST Seal Beach Boulevard and the Seal Beach Naval Weapons Center in the Public Land Use zone, (PLU). WEST A mixture of commercial buildings in the C-2 zone and residential units located in the Residential Low Density zone, (RLD); and WHEREAS, The Planning Commission of the City of Seal Beach took action at their regularly scheduled meeting of August 3, 1988, to approve Conditional Use Permit 7-88 subject to eight conditions. (See attached staff report and resolution.) One of the conditions stated that CUP 7-88 would be granted for twelve (12) months, after which time the Planning Commission would review the CUP, and could extend it indefinitely; and WHEREAS, William Stearns, Chief of Police, has reviewed the existing records, and has no reservations about permitting the operation to continue; and WHEREAS, A staff inspection of the site on September 8, 1989, revealed several alcoholic beverage advertisements located in the windows of the site. This is a violation of condition number three (3) of Resolution 1510 (enclosed); and WHEREAS, A duly noticed public hearing was held on September 20, 1989. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve a twelve (12) month extension of Conditional Use Permit 7-88, subject to the following conditions: 1. CUP 7-88 is approved for an off-sale general liquor license at 1780 pacific Coast Highway, and is issued to Julius Dibsy. 2. CUP 7-88 is non-transferrable. e e . City of Seal Beach Planning Commission Resolution No. 1553 Page 2 of 2 3. No alcoholic beverage advertising or display devices shall be located in the window areas and outside of the store. 4. With the applicant's consent, the hours of operation shall be daily 6:00 a.m. to 2:00 a.m. 5. The applicant shall comply with all restrictions placed on the license by the California Department of Alcoholic Beverage Control. 6. No video games or similar amusements shall be permitted on the premises. 7. The term of this permit shall be twelve (12) months, after which time the Director of Development Services shall review and may extend the permit indefinitely provided that all conditions of approval have been satisfied and no significant police problems have occurred. This matter shall be referred back to the Planning Commission in the event that any conditions of approval have been violated or if any significant police problems have occurred. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 20th day of September, 1989, by the following vote: BCC:bc
