HomeMy WebLinkAboutPC Res 1555 - 1989-10-04 .11 e . r- RESOLUTION NO. 1555 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 12-89, APPROVING A REQUEST FOR THE PLACEMENT OF 'lWELVE (12) VIDEO GAME MACHINES INSIDE THE LOBBY OF THE SUPER SAVER CINEMA 7 THEATRES, ROSSMooR BUSINESS CENTER. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, The Super Saver Cinema 7 Theatres, Inc. is owned by Associated Theatres, Inc., 109 No. Oregon Street, Suite 1000, E1 Paso, Texas 79901 and Lyco Financial, Inc., 4171 No. Mesa, Building D, Suite 503, E1 Paso, Texas 79902. The theatre manager is Joshua Hart Davis. WHEREAS, The subject property is located in the Rossmoor Shopping Center. It is bordered directly to the east by the Rossmoor Center shops, to the west and northwest by the (Montecito Road) parking lot, to the north by Gould Music and to the south by the Roger Dunn Golf Shop. WHEREAS, The ground floor area, consisting of the lobby, restrooms, concession storage, and all seven (7) theatres, is approximately 23,577 square feet. The lobby itself is approximately 4,410 square feet. WHEREAS, The subject property has a valid City of Seal Beach business license for theatre operation and has an a completed Conditional Use Permit application for the video games. WHEREAS, The hours the theatres will be open to the public will be 12:00 p.m. (noon) to 12:00 a.m. (midnight). The theatre operation hours will be 9:00 a.m. to 12:00 a.m. (midnight). WHEREAS, The purchase of an admission ticket will permit patrons to play video games, but such purchase shall not otherwise be required for access to the lobby. WHEREAS, The capacity of the lobby is 550 people, the total capacity for the theatre is 1,470 people. WHEREAS, There are approximately twenty-eight (28) employees working at the theatre. Four (4) employees operate the theatre during matinee hours, and ten (10) employees are on duty during weekend nights. WHEREAS, An area measuring approximately 32' x 4' along the west wall of the lobby is the proposed site for video games. WHEREAS, The theatre manager has indicated the video games will be turned off upon the closing of the ticket booth for the final shows of the evening, at approximately 10:30 p.m. WHEREAS, The theatre manager has assured staff the on-duty manager at the theatre will monitor the video game area to make sure children are not loitering in the lobby and playing video games. WHEREAS, There are racks outside the theatres to accommodate approximately thirty-five (35) bicycles. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 12-89, subject to the following conditions: 1. Staff approves CUP 12-89 for the installation of twelve (12) video game machines in the lobby of the Super Saver Cinema 7 Theatre, along the west wall. , ~ , tI - Resolution No. 1555 Page 2 of 2 2. That persons shall be allowed to play the machines only after purchasing a ticket. The exact control method shall be developed by the owner and approved by staff. It shall ensure that users are limited to ticket holders. 3. That the video game machines be turned off upon the closing of the ticket booth for the final shows of the evening, at approximately 10:30 p.m. 4. That the on-duty manager of the theatre shall monitor the video game area to prevent the loitering of individuals in the lobby. 5. That the business license fee for the video game machines be paid to complete the application process. 6. That with the applicant's consent, the theatres will be open to the public between 12:00 p.m. (noon) and 12:00 a.m. (midnight). The theatre operation hours will be 9:00 a.m. to 12:00 a.m. (midnight). 7. That no person shall be permitted to play the game machines during hours when any public or private school is in regular session in the cities of Los A1amitos, Seal Beach or the unincorporated area known as Rossmoor unless such person's age is 18 years or more. The manager-on-duty shall require identification in cases of doubt. 8. A sign not less than three (3) square feet in area shall be clearly posted at the video game area stating that the use of the machines is limited to holders of tickets for a theatre performance on the premises. 9. A sign not less than six (6) square feet in area shall be clearly posted at the video game area stating that use of the machines is not permitted by persons under the age of 18 years during school hours when any public or private school is in regular session in the cities of Los A1amitos, Seal Beach or the unincorporated area known as Rossmoor. The manager-on-duty shall require identification in cases of doubt. 10. The theatre shall comply with any ordinance or requirements that may come about regarding video machines in the future. 11. Conditional Use Permit 12-89 is to be reviewed after a period of six (6) months for compliance on the theatre's part with the above conditions and to address any negative impacts as a result of having video games in the theatre lobby. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 4th day of October, 1989, by the following vote: AYES: Commissioners Sharp, Jessner, Rullo, Suggs, Fife NOES: COmmissioners ABSENT: Commissioners BCC: be
