I r RESOLUTION NUMBER 1556 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 13-89, A REQUEST TO PERMIT A PET SHOP IN THE SERVICE COMMERCIAL ZONE, (C-1) , LOCATED AT 318 MAIN STREET (PEG I S PETS) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, On September 1, 1989, Peggy L. Fields filed an application with the Department of Development Services for Conditional Use Permit 13-89, a request to obtain a Conditional Use Permit for an existing pet store located at 318 Main Street, as required in Section 28-1300 of the Code. The applicant is further requesting to provide low cost animal vaccinations on a monthly basis; and WHEREAS, The subject property is an irregularly shaped parcel located on the east side of Main Street; and WHEREAS, The property contains an existing pet store, which has been in existence since 1969. At that time a Conditional Use Permit was not required for a pet store in the C-l zone. However, since 1974 a CUP has been required for a pet store in the C-1 zone, and any changes in ownership subsequent to 1974, should have required a CUP; and WHEREAS, The applicant leased the subject property in April of 1984. At that time, a Conditional Use Permit should have been required, prior to the issuance of a business license; and WHEREAS, The applicant submitted an Activity Request Form to the Public Works Department on May 19,1989 (enclosed). The request was for the provision of low cost animal vaccinations; and WHEREAS, In its review of the above mentioned Activity Request Form, Planning staff discovered the absence of a CUP for the operation. Staff subsequently required the applicant to obtain a CUP prior to any consideration of the request for a low cost vaccination clinic; and WHEREAS, The surrounding land uses and zoning are as follows: NORTH, SOUTH & WEST COmmercial establishments in the Service Commercial zone, (C-l). EAST Residential Uses in the Residential High Density zone, (RHO); and WHEREAS, A duly noticed public hearing was held on October 4, 1989. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 13-89, subject to the following conditions: 1. CUP 13-89 is approved for a pet store located at 318 Main Street and issued to Peggy L. Fields. 2. The applicant is permitted to operate a low cost vaccination clinic fram the site. 3. With the applicants consent, the vaccination clinic will operate during normal business hours on one Saturday of each month. 4. A licensed veterinarian shall be the sole person allowed to administer animal vaccinations. ~... , , .. ,. .. .- City of Seal Beach Planning Commission Resolution No. 1556 Page 2 of 2 5. Vaccinations shall be carried out within the building housing the pet store and shall not be permitted along the sidewalk or any other City right-of-way. 6. The attending veterinarian shall possess a valid City business license prior to operating the vaccination clinic within the Ci ty limi ts.
