RESOLUTION NUMBER 1557
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING AN
INDEFINITE EXTENSION OF CONDITIONAL USE
PERMIT 10-88, A REQUEST FOR AN OFF-SALE
GENERAL LIQUOR LICENSE IN CONJUNCTION WITH
AN EXISTING GROCERY STORE LOCATED AT 1101
PACIFIC COAST HIGHWAY (VONS)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:
WHEREAS, On September 21, 1989, Patricia Weimer contacted staff on behalf
of the Vons Companies, Inc. requesting a renewal of CUP 10-88;
and
WHEREAS, The applicant subsequently filed for an extension of CUP 10-88,
which was originally a request to transfer an existing off-sale
general liquor license in conjunction with the transfer of
ownership of an existing grocery store at 1101 Pacific Coast
Highway; and

WHEREAS, The subject property is located in the Seal Beach Center, a
multiple-tenant center located between Balsa Avenue and Balboa
Drive North of Pacific Coast Highway; and
WHEREAS, The surrounding land uses and zoning are as follows:
NORTH
Across Balsa Avenue are single family homes in the
Residential Low Density zone, (RLD).
SOUTH
A mix of commercial and residential uses in the
General Commercial zone, (C-2) and the Residential
High Density zone, (RHO).
EAST
Across Balboa Drive are single family homes in the
Residential Low Density zone, (RLD).
WEST
A mix of commercial and residential uses in the
General COmmercial zone, (C-2) and the Residential
High Density zone, (RHO); and
WHEREAS, The Planning Commission of the City of Seal Beach took action at
their regularly scheduled meeting of October 5, 1988, to approve
Conditional Use Permit 10-88 subject to nine conditions. (See
attached staff report and reSOlution.) One of the conditions
stated that CUP 10-88 would be granted for one year, after which
time the Planning Commission would review the CUP, and could
extend it indefinitely; and
WHEREAS, The hours of operation are 24 hours a day, seven days per week;
and
WHEREAS, William Stearns, Chief of Police, has reviewed the existing
records, and has no reservations about permitting the operation
to continue; and
WHEREAS, A staff inspection of the site on October 9, 1989, found the
applicant to be meeting all conditions of Resolution No. 1520;
and
WHEREAS, A duly noticed public hearing was held on October 18, 1989.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of
Seal Beach does hereby approve an indefinite extension of Conditional Use
Permit 10-88, subject to the following conditions:
1. CUP 10-88 is approved for an off-sale general liquor license at
1101 Pacific Coast Highway, and is issued to The Vons Companies,
Inc.

2. All alcoholic beverages sold in conjunction with the store shall
be for off-site consumption only.
3. No video games or similar amusements shall be permitted on the
premises.
4. No alcoholic beverage advertising or display devices shall be
located in the window areas and outside of the store.
5. The applicant shall comply with all restrictions placed on the
license by the California Department of Alcoholic Beverage
Control.
6. CUP 10-88 is non-transferrable.
7. No sales of alcoholic beverages shall take place between the
hours of 2:00 a.m. and 6:00 a.m.
8. With the applicant's consent, the hours of operation for the
market shall be 24-hours a day, seven days a week.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of
Seal Beach at a meeting thereof held on the 18th day of October, 1989, by
the following vote:

Commissioners Sharp. Rullo. Fife, Suggs, Jessner.
