RESOLUTION NUMBER 1558
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING CONDITIONAL
USE PERMIT 14-89, A REQUEST TO ADD A SECOND
NAME TO AN EXISTING TYPE "42" PUBLIC PREMISES
BEER AND WINE LICENSE, AND TO ESTABLISH A CUP
FOR ON-SALE BEER AND WINE AT 1500 PACIFIC COAST
HIGHWAY, SEAL BEACH (DAVE'S OTHER PLACE)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, On September 18,1989, Douglas Hoxeng submitted (for
himself and David J. Stangeland) an application for
Conditional Use Permit 14-89 to the Department of
Development Services, a request to add his name to the
existing "42"-Public Premises beer and wine license.
In conjunction with the applicants' request, staff is
establishing a CUP for on-sale beer and wine at 1500
Pacific Coast Highway, Seal Beach. (Dave's Other
Place); and
WHEREAS, The subject property is located in the General
Commercial Zone (C-2), on the first floor of a two-
story office building at 1500 P.C.H.; and
WHEREAS, The subject property is bordered to the north by
residential low density (RLD) housing (across P.C.H.),
to the south by residential medium density (RMD)
housing, to the west by The Glide'er Inn, and to the
east by Stegens Automotive Garage; and
WHEREAS, The square footage of Dave's Other Place is 904.75
square feet, 596.85 sq. ft. of which is drinking and
dining area for patrons of the bar; and
WHEREAS, The applicants are specifically requesting CUP 14-89 to
permit the continuing operation of the existing bar
with the addition of a second name to an existing "42"-
Public Premises beer and wine license; and
WHEREAS, Dave's Other Place has previously not had a CUP for on-
sale beer and wine (due to its grandfathered status);
and
WHEREAS, The applicants' current and proposed hours of operation
are:
8:00 a.m. to 12:00 a.m. (midnight), daily; and
WHEREAS, Chief Bill Stearns and Lieutenant Ben Holt of the Seal
Beach Police Department have both indicated that Dave's
Other Place is in good standing with the Department
with regard to resident complaints; and
WHEREAS, A duly noticed public hearing was held on November 1,
1989; and
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the
City of Seal Beach does hereby approve Conditional Use Permit
14-89, subject to the following conditions:
1. CUP 14-89 is approved for the addition of the name Douglas
Hoxeng to the existing type "42"-Public Premises beer and
wine license and the establishment of a CUP for on-sale beer
and wine at 1500 Pacific Coast Hwy, Seal Beach (Dave's Other
Place) .
2. That all alcoholic beverages be consumed on the premises.

3. That the applicants shall comply with all restrictions
placed upon the license by the State Department of Alcoholic
Beverage Control.
4. That CUP 14-89 is non-transferable.
5. That there shall be no alcoholic beverage advertising
display devices located in the window areas.
6. That with the applicant's consent, the hours of operation
shall continue to be from 8:00 a.m. to 12:00 a.m.
(midnight).
7. The term of the permit shall be for twelve (12) months,
after which time the Planning Commission may extend the
permit indefinitely provided that all conditions of approval
have been satisfied, and no significant police problems have
occurred.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 1st day of
November, 1989, by the following vote:
