RESOLUTION NUMBER 1561
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING AN
INDEFINITE EXTENSION OF CONDITIONAL USE
PERMIT 12-88, A REQUEST FOR AN ON-SALE
BEER AND WINE LICENSE IN CONJUNCTION
WITH AN EXISTING RESTAURANT (DELI) LOCATED
AT 303 MAIN STREET (MAIN STREET DELI)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:
WHEREAS,
On November 16, 1988, the Planning Commission of the City of Seal
Beach approved CUP 12-88 with SEVEN (7) conditions in place; and
WHEREAS,
Condition 6 approved Conditional Use Permit 12-88 for a term of
one (1) year, after which time the Planning Commission shall
review the CUP and may extend it indefinitely; and
WHEREAS,
William Stearns, Chief of Police, has reviewed the existing
records, and has no reservations about permitting the operation to
continue; and
WHEREAS,
A duly noticed public hearing was held on December 6, 1989.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve an indefinite extension of Conditional Use Permit
12-88, subject to the following conditions:
1. The indefinite extension of CUP 12-88, a Type "41" license for on-sale
beer and wine at a public eating place, at 303 Main Street, Seal Beach
(Main Street Deli), is approved.
2. The applicant shall continue to observe all previous conditions placed
on the subject property under Resolution 1525, as well as any additional
conditions the Planning Commission wishes to establish at this time.
3. Condition #2 of Resolution #1525 shall be rewritten to state "All
alcoholic beverages shall be consumed entirely on the premises, and none
shall be sold as take-out".
4. All alcoholic beverages served on the premises shall be served in glass
containers.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal
Beach at a meeting thereof held on the 6th day of December, 1989, by the
following vote:
