RESOLUTION NO. 1239
A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING
CONDITIONAL USE PERMIT, CP-5-8l FOR ON-SALE BEER AND WINE IN
CONJUNCTION WITH A RESTAURANT AT 909 OCEAN AVENUE
WHEREAS, an application was duly filed by Senior Corky.s, The Dunes
Cafe (Mark Gill), 909 Ocean Avenue, Seal Beach, for CP-5-8l; and
WHEREAS, the property is described as lots 5 and 6, Block 9, Bay City Tract
and is more commonly known as 909 Ocean AVenue; and
WHEREAS, the proposal is for on-sale beer and wine in conjunction with the
existing restaurant at that location; and
WHEREAS, the Planning Commission makes the following findings regarding the
application:
1) The sUbject property is located more than 300 feet from any
church or school.

2) The subject property has been continually used for restaurant
. purposes for more than 10 years.
3) The applicant proposes to change the food service concept
from seasonal "fast food" to year around family-oriented dining.
4) No problems are anticipated with the proposed use at that
location.
NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission does hereby
approve CP-5-8l subject to the following conditions:
1) CUP issued to Mark Gill.
2) CUP for beer and wine only at 909 Ocean Avenue.
3) CUP to be issued for one year with provision for renewal.
