RESOLUTION NUMBER 1296 A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING AND RECOMMENDING TO CITY COUNCIL ZDOPTION 'OF A ZONING TEXT AMENDMENT PERMITTING ENTERTAINMENT BY ISSUANCE OF A CONDITIONAL USE PERMIT AND ADOPT- ING A POLICY STATEMENT THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES: ... WHEREAS, live entertainment and dance licenses are currently regulated through Chapter 7A of the Code of the City of Seal Beach; and WHEREAS, the provisions of Chapter 7A do not provide for public hearings or public notices prior to issuance of the license; and WHEREAS, in order to insure neighborhood compatibility, entertainment and/or dancing licenses should require public hearings prior to issuance; and . WHEREAS, in order to evaluate applications for entertainment permits the Planning Commission should adopt a policy statement governing such applications. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby adopt policy statement Exhibit A, approves and recommends to City Council a zoning text amendment requiring a conditional use permit for entertainment licenses and recommends that Chapter 7A of the Code of the City of Seal Beach be repealed. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 6th day of July, 1983 by the following vote: AYES: Commissioners Covington, Jessner, Smith, Perrin, Goldenberg NOES: Commissioners None ABSENT: Commissioners . ~~ Secretary to Planning Commission . . . ~~ 1~1' EXHIBIT A Seal Beach Planning Commission Entertainment Permit/License Policy Statement Introduction The provisions of this statement apply to all entertainment and/or dancing in any facility open to the general public. General The Planning Commission will evaluate the following prior to issuance of a CUP for entertainment and/or dancing: 1) Location of the building in relation to all surrounding land uses, including but not limited to: schools, churches and residential land uses. 2) The type of use in the building and the types of uses proposed. 3) The existing hours of operation and any modifications to the hours of operation. 4) Existing traffic impacts and a reasonable evaluation of changed traffic impacts. 5) The type of entertainment and/or dancing proposed. 6) The ambient noise level outside the building and sound attenuation measures proposed. 7) A projection of decibel levels in the building. 8) Available parking, both on-site and off-site. Conditions As part of the conditional use permit approval, the Planning Commission may impose conditions to insure compatibilty incuding but not limited to: 1) Hours of operation 2) Sound Attenuation Measures 3) Interior & Exterior Decibel Limit Levels 4) Type of Music Permitted 5) Parking Control Measures 6) Provision of a decibel meter on premises 7) Any other reasonable condition to insure compatibility to surrounding land uses.
