RESOLUTION NUMBER 1300
A RESOLUTION OF THE SEAL BEACH PLANNING COt1~lISSION
DENYING VARIANCE, V-1-83 FOR AN ENCROACHMENT INTO
A 3-FOOT SIDEYARD SETBACK AT B-114 SURFSIDE.
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES:

WHEREAS, an application was duly filed by Donald and Myrna Jacobson, 10402
E1 Dorado, Los A1amitos for Variance, V-1-83; and
\mEREAS, the property is described as, Lot 114, Block B, Surfside Colony
and is more commonly known as B-114 Surfside; and
WHEREAS, the proposal is to permit a house to occupy a portion of a three
foot side yard; and
WHEREAS, the Planning Commission makes the following findings;
1. The subject property was not surveyed prior to preparing
plans.
2. The building was constructed improperly on the lot so
that a portion of the building was constructed over the
property 1 i ne.
3. The variance was to remove that portion of the building
over the property line.
4. All "hardship" with this application was created by the
applicant.
5. No hardship as defined by code exists with this application.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission does hereby deny
variance, V-I-83.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal
Beach at a meeting thereof held on the 17th day of August , 1983
by the following vote:
AYES: Commissioners Covington, Goldenberg, Jessner, Perrin, Murphy
NOES: Commi ss i oners None
ABSENT: Commissioners None
