V-7-65 TO CONSTRUCT AN EIGHT UNIT APARTMENT BUILDING AT 1005 OCEAN AVENUE WITH REDUCED SIDE YARD REQUIREMENTS ALONG' PORTIONS OF THE BUI~DING. WHEREAS. in the matte+ of the Variance Application No.'V-7-65. the Planning , Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by owners. Mr. and Mrs. Brady ~. Shute. 1000 Ocean Ave.. Seal Beach. Telephone No. 431-8870. 2. Subject proposal is for construction of an 8 unit apartment building on Lots 3. 4 and westerly ~ of Lot 5, Block 10. Bay City Tract, which is 1005 Ocean Avenue. Permission to construct with certain substandard sideyards along portions of the building is requested. Permission is also requested to construct said 8 units with total land area being 325 square feet less than the. amount required by code for said 8 units. WHEREAS, the Planning Commission findings are as follows: 1. Side yard width required by ordinance is 6'311 (being 10% of lot width of 62.5'). e 2. Requested reduction in sideyard width is as folaows: (a) at the rear 32' of the building, where a 6 space auto garage is located. the requested side yard on the southwesterly side is 3 feet and the requested side yard on the northwesterly side is 4 feet; (b) along the remainder of the southwesterly side the requested side yard is 5 feet. 3. By a previous study and action of this Planning Commission, recommendation has been made to the City Council to change the requirement of 10% side yards to 5 foot side yards for all R-l, R-2, R-3 lots 50 feet wide and greater. 4. The proposed reduction to 3 foot and 4 foot sideyards along the rear 32 feet of the building is for the purpose of providing 6 off-street parking spaces (in enclosed garage) at the rear alley location. thus requiring only 2 garages facing on Ocean Avenue. This design provides a better appearance from the street side and also results in retaining one more parking space on the street. 5. The total land area required by city code for the construction of 8 apartment units is 7200 square feet. The subject property contains 6,875 square feet, or a net shortage of 325 square feet. The planned layout and use of the land is excellent, and the construction of 8 apartment units is acceptable as presented. NOW. THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Seal Beach does hereby approve Variance Application No. V-7-65 to allow construction of an 8 unit apartment building on Lots 3.,4 and the westerly ~ of lot 5, Block 10.
