V-lO-65 FOR A REDUCTION OF REAR YARD SETBACK AND INCREASE IN MAXIMUM LOT COVERAGE AT 701 TAPER DRIVE. WHEREAS, in the matter of Variance Application No. V-lO-65, the Planning Commission of the City of Seal ~each does report as follows: 2. , Subject case was ~nitiated by Harvey E. Webb, Jr., 701 T~per Drive, Seal Beach. Subject proposal i~ to construct an addition to an existing structure on Lot 41, Tract 2590, wh~ch is 701 Taper Drive. Permission requested for a sub- standard rear yard and an increase in the maximum lot coverage. By Resolution No. 3~, dated July 7, 1965, the Planning Commission of the City of Seal Beach denied this variance request on the basis that no exceptional conditions or extraordinary circumstances were found that did not apply to the general area and no property rights were denied to this property owner that were available to other property owners in the area. 1. 3. . 4. The City Council of the City of Seal Beach on July 16, 1965 found that extra- ordinary circumstances did exist relating to this property, in that the atrium plan of the house used up more than the usual amount of land space, making it difficult to construct additions onto the existing structure without a variance of the nature requested. The case was referred back to the Planning Commission for further study and action. WHEREAS, the Planning Commission findings are as follows: 1. The rear yard setback required is 10 feet and the maximum lot co~erage allowed is 40%. 2. The request is as follows: to allow construction of an addition to the present structure with a 6 foot rear year and 45.7% lot coverage. 3. The City Cduncil by its action of July 16, 1965 has indicated that the difficulties caused by this particular type of atrium plan are acceptable as extraordinary circumstances. 4. Based upon finding No. 3 above, the Planning Commission finds that this would not be a grant of special privilege. 5.
