V-14-65 . \fIIEREAS, in the matter of Variance Application No. V-14-65, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by William E. and Norma F. Roth, 1505-07 Ocean Ave. 2. Subject proposal is for constructing a second Rtory addition to the rear of the apartment bui1dinR located at 1505-07 Ocean Ave. Said addition requested to extend to the alley property line. 3. Legal description of the property is Lot 37 and \!1y l.l of Lot 36, Block C, Tract t\o. 1. WHEREAS, the Planning Commission findingR are as follows: 1. Applicants propose to build an overhanging addition to the rear of their building, keeping the ground level set-back at its present distance of 9 feet. 2. Two or.al protests were received, based on the narrowness of the alley (12 ft.) and on tlu~ fact of shutting out the liJ;ht. air and view of a next door neighbor. On~ affirmative statement from a neighboring property owner was heard, declaring that the proposed work would upgrade the area. 3. No other buildings have been allowed to be constructed to the rear alley line in this neighborhood and zone, therefore the proposed action would be a grant of special privilege. 4. Many other buildings have been allowed to be constructed to within 2 feet of the rear alley line (above the. first floor only) under provisions of our old zoning ordinance. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby grant a variance to Hr. & ~Irs. toli1liam Roth to construct an overhanging addition (on the second floor only) at the rear of their apartment building at 1505-07 Ocean Avenue, Seal Beach. A two foot rear yard shall be maintained between the proposed addition and the alley property line.
