RESOLUTION NO. 64
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF SEAL BEACH APPROVING VARIANCE APPLICATION
NO. V-S-66 TO CONSTRUCT A 'MULTI-STORY APARTMENT
BUILDING EXCEEDING THE EIGHTY FOOT (80') HEIGHT
LIMITATION AND PROVIDING LESS THAN THE REQUIRED
TWENTY TWO FOOT (22') REAR YARD (LOADING AREA)
AT THE ALLEY.
wHEREAS, in the matter of VAriance Application No. V-S-66, the Planning Commission
of the City of Seal Beach does report as follows:
1.
Subject case was initiated by owner, Adam J. Pawlak, 8121 Pennington Drive,
Huntington Beach, California.
2.

Subject proposal is for construction of a multi-storied apartment building
(10 or more stories, R-4 use, exceeding 80 feet in height) on a vacant parcel
of land.
3.
Subject location is on Lots 1, 2,,3, 4 & S, Block 8, Bay City Tract, at the
northeast corner of Ocean Avenue and 8th Street and is in the C-2 Zone.
4. Proposed use is allowable in the C-2 Zone with a conditional use permit.
However, a variance for exceeding the R-4 heigh~ limitation and to provide
less 'than the required 22 foot rear yard is ne~essary to construct the
~ building as shown on the preliminary plans.
WHEREAS, the Planning Commission findings are as follows:
1. No protests, written or oral, have b~en received. One letter has been
received from an abutting property owner indicating approval and making some
comments regarding the proposed use.
2. This is one of the largest single parcels in the beach area of the city which
is also in a zone allowing high-rise building. However, it is understood
that to make such a proposal economically feasible, it must be possible to
build to a greater height than eighty feet (80').
3. The twenty two foot (22') rear yard required at the alley in the C-2 Zone is
intended to provide commercial vehicle unloading space to keep the alley clear.
Since the proposed use will be for residential apartments only, there is no
need for a commercial unloading area. However, the nine foot (9') rear yard
requirement for turning radius of automobiles into parking ~arage is necessary
(as required in the residential zones). Therefore, the minimum clear rear
yard for this proposed use shall be nine feet.
4. This variance shall not be effective without an accompanying use permit for
the proposed use, approved by the Seal Beach Planning Commission.

NOW, THEREFORE, BE IT RESOLVED that ,the Planning Commission of the,City of Seal
Beach does hereby approve Variance No. V-5-66, as stated above, subject to the
requirements stated in the findings above. ,
