UV-5-66, RESIDENTIAL USE IN A C-l ZONE AND RESCINDING PLANNING COMMISSION RESOLUTION NO. 95 (HERBERT L. BENEDICT) WHEREAS, in the matter of Use Variance Application No. UV-5-66, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by Mr. and Mrs. Herbert L. Benedict, 9302 East Florence Avenue, Downey, California. 2. Request is to permit construction of dwelling units in C-l Zone. ; 3: Legal description of property is Lot 8, Block D, Tract No. 1 and Easterly fifteen feet of Lot 5, Block H, Tract No. 1009. Street address is 1421 Seal Way, Seal Beach. WHEREAS, the Planning Commission findings are as follows: . 1. Planning Commission approval of this Use Variance was granted by Resolution No. 95, dated November 23, 1966, and the Use Variance was forwarded to the City Council for approval. The City Council referred the matter back to the Planning Commission to consider requirement of dedication of a portion of the rear of the property to provide for future widening of Seal Way Alley. Revised plans have been submitted by Mr. James A. Stevens, architect for Mr. and Mrs. Benedict. 2. No protests were received, written or oral. 3. There are many other residential units in this particular C-l Zone. 4. The proposed structure would be an improvement for the area. 5. Because this is C-l property and abuts commercially developed property, exceptions from usual residential set back requirements are reasonable. 6. The plan, _,as revised and dated December 20, 1966, is acceptable provided that the following conditions are met and maintained: (a) Walkways shown on ground level must be open and accessible for emergency access. (b) The balcony on the northwesterly side toward the front of the building must not encroach closer than two feet from the side property line. (c) The building shall be constructed and maintained substantially as shown on the plans dated December,20,1966,particularly in providing the . indicated amount and arrangement of light and air space. A five (5) foot wide strip across the rear of the property should be dedicated to the City of Seal Beach for future alley widening purposes. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby rescind Resolution No. 95 and does hereby approve Use Variance No. UV-5-66 permitting construction of dwelling units in a C-l Zone as submitted, subject to the following conditions: J 1. All requirements of findings Nos. 6 and 7 above must be met. 2. This Use Variance shall not become effective until approved by the City Council of the City of Seal Beach.
