RESOLUTION NO. 120 A RESOLUTION OF THE PLANNING CO~IISSION OF THE CITY OF SEAL BEACH DECLARING OPPOSITION TO SECTION l3l(g) OF PUBLIC LAW 89-285, THE HIGHWAY BEAUTIFICATION ACT OF 1965, AND URGING CONGRESS TO DELETE SAID PROVISION BY APPROPRIATE AMENDMENT, AND FURTHER RECO!otMENDING TO THE CITY COUNCIL OF THE CITY OF SEAL BEACH TO TAKE SIMILAR ACTION. WHEREAS, the Congress of the United States has heretofore enacted the Highway Beautif1cation Act of 1965 for the purpose of provid1ng for scen1C development and road beautification of the federal-state highway systems and that such Act contem- plates and requ1res action by the several States; and WHEREAS, Section l3l(g) of the Act requires payment of compensation upon the removal of certain outdoor advertis1ng s1gns; displays and devices, such compensa- tion to be shared by the fed~ral government and the States; and WHEREAS, with respect to the State of Californ1a, payment of compensat1on for such removal is unnecessary and wasteful because such removal and the consequent securing of "effect1ve control", as def1ned in the Act, can better be accompl1shed under the police power of this State; and . WHEREAS, over a period o~ many years the po11ce power of the States has become and now is the well established and Judicially recogn1zed means of enforc1ng zoning and sim1lar land use controls, and, accord1ngly, the compensation prov1sion in the Act is likely to confuse and underm1ne established pract1ces and procedures, NOW, THEREFORE, BE IT RESOLVED by the Plann1ng Commiss1on of the City of Seal Beach that th1s body hereby declares its opposition to Section l3l(g) of Public Law 89-285, the Highway Beautif1cation Act of 1965, and urges the Congress to delete said provis1on by appropriate amendment to the act; IT IS FURTHER RESOLVED that the Secretary be, and he is hereby, directed to prepare a certified copy of these resolut1ons and forward them to United States Senators Thomas H. Kuchel and George Murphy and to Honorable R1chard Hanna, Representative in Congress; AND IT IS FURTHER RESOLVED that the Planning Commission does reCOMmend to the City Counc1l of the City of Seal Beach take s1milar act10n regard1nR th1s mat ter.
