RESOLUTION NO. 121 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING VARIANCE APPLICATION No. V-7-67, CONSTRUCTION OF A ONE BEDROOM APARTMENT ABOVE A GARAGE AT 1624 OCEAN AVE. (MR. & MRS. J. E. DENISON) WHEREAS, in the matter of Variance Application No. V-7-67, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by Mr. and Mrs. J. E. Denison, 12 Governor Rd., Stoneham, Mass. Authorized agent for Mr. and Mrs. Denison is E. R. Mitchell, General Contractor, 16742 16th St., P.O. ~ox 586, Sunset Beach, California. 2. Request is to permit construction of a one bedroom apartment above a garage at the rear of an existing single family residence and to be attached to the single family residence. Request includes variance from both the rear yard setback requirement and one sideyard setback requirement. 3. Legal description of property is Lot 13, Block F, Tract NO.1. Street address is 1624 Ocean Ave., Seal Beach. WHEREAS, the Planning Commission findings are as follows: . 1. One verbal protest was received from Mr. Uenry Espoy. 2. The alley at the rear of subject property is twelve feet wide. The request is that the setback from the alley at the ground floor shall be eleven feet rather than the required twelve feet. This request of one foot reduction at the ground floor level is reasonable and proper since the existing one story garage is now located at this setback. 3. The proposed second story apartment is indicated as overhanging the ground floor to the rear to a point seven feet from the existing alley line. This encroachment into the rear yard requirement at the second story level only is acceptable. 4. The request for reduction in the minimum sideyard requirement on the south side of the garage to two feet is not acceptable and the required three foot side yard setback shall be maintained. 5. The narrow width of the public alley to the rear of subject property causes severe traffic problems. Addition of more apartment units such as in the subject case will cause additional traffic to be generated along this alley. A six and one-half foot wide strip across the rear of subject property shall be dedicated to the City of Seal Beach for future alley widening purposes and for public utility purposes. . /~~l./ ~ e e ,-- ~ Resolution No. 121 - 2 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance Application No. V-7-67 for the reduction in rear yard setback requirements as stated in Findings No. 2 and 3 above. Request for variance from sideyard setback is denied in conformance with Finding No. 4 above. Granting of approval of this rear yard variance is subject to Finding NO. S above, the dedication by the property owner of the six and one-half foot wide strip across the rear of the property for future alley widening and public utility purposes. This variance shall not become effective until said dedication has been signed by the property owner and has been recorded.
